    OK so there is a record at your former work place that you complained about being sexually assaulted and they did nothing. That’s your evidence. You spoke to XXX on X/X/2023 and reported being sexually assaulted.. Go straight to the police. They are the best ones to deal with this. It’s a criminal offence. Once you have reported this to the police , they have the powers to seize records and documents as it is a criminal investigation. Won’t look good on their part. Give the police all the details of where and when you complained and also when these assaults took place. Did any other of your work colleagues complain to you or you observed being sexually assaulted? They will be witnesses too. Did you discuss this with any other work colleague?

    To add onto what others have said, please report it to the police SOON, CCTV legally has to be removed within I think 2 months and you donÔÇÖt want that to happen. You also donÔÇÖt want them to delete the evidence

    Remember: HR exists to protect the *company,* not the employees. In future be aware that anything filed with HR is You vs The Company, they aren’t there for you.

    So common for HR to cover their asses and close ranks to protect the company.

    Something similar happened to me, management scapegoated me, and now I’m suing. Got a no-win no-fee lawyer. The statute is 12 months and you need surprisingly little in civil court to bring a case of workplace sexual misconduct. My lawyer lodged a statement of complaint with the Human Rights Commission.

    You should definitely consider reporting to police. Unfortunately the system doesnÔÇÖt easily take the side of the victim. It can get very ugly especially if it ends up in charges. They will try to embarrass every aspect of your life to make you out to either be a willing participant or a liar. I hope you get the outcome you deserve.
