Who ever is the guardian needs to request a meeting with administration and the teacher – if there is a coordinator for the IEP include them too. If nothing happens at that level go to the school division.

The teacher mentioned lack of Math skill. Extending a test an hour if she doesn’t know the Math isn’t going to magically make her know the topic.
My first question is why isnÔÇÖt the parent dealing with this? Are you your sisters guardian? WhereÔÇÖs mom or dad in the picture?
And frankly the guardian needs to call the school and schedule a meeting with the principal, to lay out all the facts regarding the math teacher and him seemingly targeting a student with a disability.
At one point, while advocating for my child with ADHD, I had to escalate over the principal’s head to the school district and the head of principals.
This was in British Columbia.
It worked. I got her attention and the resources we needed in school.
You are 18 – go on about YOUR life and let your parents and sister worry about her life.
Your sister needs to go to her guidance counselor, SERT and other teachers for support. The IEP is a legal document that the teacher has to accomodate…your sister does not need to argue with her teacher about it, she needs to talk to Guidance and her SERT.
But all you can do is tell her that and then go on with your life. Because you are not her parent or legal guardian.
It seems like an IEP in Ontario is recognized as a legal document. Have your parents or yourself reach out maybe to this organization, and perhaps they have resources that could support your sister so she can have the help she needs.

If an IEP is being ignored your sister is likely in the realm where a human rights complaint along with a *demand,* not a request, to have the her transferred to a different class can be made.

Though I want to make sure; are your parents just dealing with the teacher, or have they escalated to the guidance councillor/principal/superintendent? A lot of these issues can be dealt with administratively through the schools chain of command even if a specific teacher is a problem.
If they have exhausted avenues right up to the superintendent and an IEP is still being ignored- then an OHRC complaint may be the next step.
Gotta talk to the principal. If the principal doesn’t do anything talk to the superintendent. If they don’t do anything get your school trustee involved. And at that point you may need to threaten a Human Rights Tribunal complaint.
Accommodating a disability is a legal requirement under both the *Human Rights Code* and the constitution.
Your parents should first talk to the principal and see if the school has resource teachers who can work with learning disabilities, and ask for your sister to have her math lessons there. The teachers might be working with other kids for part of the time, but when they’re teaching her, they will give her one on one attention.
They should document the date that they spoke to the principal via emailing the principal after. “In summary, we discussed that [your sister]’s IEP is not being followed by [math teacher], and effective immediately we would like her moved to the resource room for math lessons”. Then if they need to escalate, they have it on record that they attempted to resolve with the principal first. The next step would be to go to the superintendent and complain that a documented learning disability is being ignored.
Source: my mom is a retired teacher who spent 20 of 33 years of her career teaching special Ed. She also had the role of “teacher in charge” which meant she handled issues in the absence of the principal and vice principal.

The Principal is required to ensure that the IEP is properly implemented. If the Principal is not aware of the issue, the Principal cannot do anything. If the Principal refuses to properly implement the plan, then your sister’s human rights have been violated and a claim can be made through the OHRC. Problem is that the backlog is years long at that OHRC. Your sister does not necessarily need a lawyer, but she needs someone who will speak on her behalf and this is not or should not be your job.
If setting the Principal straight does not work, the informal recourse rather than the OHRC would be (1) whoever is responsible for IEPs and disability at the board level; (2) your MPP; (3) the ombudsman.
Where is a special ed department in all this? Head of the department? Assistant Head? SERTs? Student Success team? Guidance? VPs and Principal?
You need your parents to make official complaints and back it up with legal actionthats the only waymake sure you documents his behavior somehow meaning testimony from classmates etc but your lawyer can help you with that
