Title: AI Legalese Decoder: Helping Navigate a Complex Legal Situation
Introduction:
In a perplexing and challenging situation, I find myself seeking guidance and assistance for my son’s predicament. A few years ago, my son, now 26, had a life-altering accident that resulted in significant cognitive impairment. Despite this setback, he remains eager and optimistic, albeit grappling with confusion and limited logical reasoning abilities. As his primary caregiver, I am confronted with a recent issue that necessitates urgent attention and resolution.
The Incident and Consequences:
Recently, I allowed my son to use my smartphone, focusing on educational resources such as audiobooks and documentaries. It seemed to bring him joy and aid in his overall well-being. However, unwittingly, he became entangled in an online community with unforeseen consequences. According to his account, discussions centered around expressing negativities towards a particular group of people that he vehemently opposed. Motivated by his strong feelings, my son decided to express his views by contacting those individuals.
Unfortunately, the outcomes were far from favorable. The repercussions of my son’s actions materialized swiftly, and he now finds himself at the receiving end of a Civil Warrant originating from several states away. He recalls making two phone calls and subsequent phone records affirm his admission. However, the sheer volume of calls that evening indicates a prolonged period of verbally abusive calls made by my son ÔÇô leaving a trail of regrettable voicemails.
My Concerns and Circumstances:
The gravitas of the situation is exacerbated by my son’s mental incapacities, rendering him unable to fully comprehend the implications of his actions. It is clear that his intellectual limitations, coupled with his emotional fervor, led him to utter offensive and hurtful messages. Given his circumstances, I firmly believe that holding him accountable is an undue burden and not in line with the intention of a lawsuit seeking a resolution to this isolated incident.
The Financial Strain:
Adding to the complexity of this predicament is the fact that my son does not possess any significant financial assets or means to fulfill any monetary compensation sought in the lawsuit. With a complete absence of income and limited possessions, the legal demand for $25,000 is overwhelming and seemingly impractical. Furthermore, I, as his mother, am unable to travel vast distances due to my own financial constraints and mandatory work commitments.
Engaging with the Plaintiff:
Driven by a genuine desire to find a reasonable resolution, I attempted to establish communication with the plaintiff. Regrettably, my attempts to connect have proven fruitless, with no response forthcoming. The plaintiff, a lawyer representing himself, has shown an unwillingness to engage in dialogue, leaving me feeling confused, scared, and utterly lost.
The Role of AI Legalese Decoder:
In this bewildering situation, I find solace in the emerging world of artificial intelligence tools such as the AI Legalese Decoder. ****** just grabbed a
1. Breathe, no one is going to jail, this is a civil matter, and will likely be settled outside of the court room.
2. I want to know about how you were served the court papers. Were they handed to you by a process server?
3. What state are you in?
4. What state is the Plaintiff in?
5. The next thing to do is to contact your local legal aid society and ask advice on how to proceed. They may be able to set you up with an attorney that can help pro bono (free).
6. If your son has a state appointed social worker or case worker – get them involved (there may be legal assistance funds available to him).
Could this be a scam? It sounds very much like it could be. Did you Google the lawyer and call the phone number from the website? Not the phone number on the letter? If you have not done that, I would start there, because it could be a scam. I would also check if a lawsuit has actually been filed. The clerk of court in the jurisdiction where the other party lives should be able to tell you if a suit has been filed
Really, it sounds as if your son is judgement-proof. He has no income or assets and no need for a credit rating. ÔÇ£LosingÔÇØ a lawsuit (even a default judgment where he does not appear) would result in a piece of paper worthless to the plaintiff.
Lawyer here (not your lawyer).
If you received documents, they should say which court this alleged law suit has been filed in. Call that court in the morning and ask if this is a real case. This does sound like it may be a scam. IÔÇÖve personally never heard of a claim of ÔÇ£outrageous harassing phone calls,ÔÇØ but complaints are not always perfect. Some states allow service of process via mail. But ultimately, you need to call whatever court is listed and find out if this is a real case. If it is real, do not ignore it or the case could be put in default. If it is a real case, look into legal aid services that can help you and your son through the process.
I work for competency court! If you or your lawyer raise the question of if he is competent to proceed the courts will be mandated to order a psychological evaluation. That will basically pause all court proceedings until this is resolved. If they deem him perle any Ku incompetent there is a high chance theyÔÇÖll dismiss his case or they will approach it a different way. Good luck op!
The Pennsylvania bar has a legal aid page you maybe should check out: https://www.palawhelp.org/
I did some checking, because $25,000 seems like an odd amount to sue for. That’s not nearly enough to bother a real lawyer with an out of state lawsuit. It turns out that that’s the limit of damages in in Tennessee general sessions civil court. That’s what they call “small claims court”.
In small claims court, you don’t need a lawyer and all judgements are rendered by a judge.
You should read the documents carefully or have someone help you. There may be a way for you to respond by mail. See if there is a hearing date. You should be able to attend via video conference/Zoom since you are out of state. Check the county that the suit was filed in for more information about their court procedures.
Do the papers that you were served list any specific damages, or does it just say that your son made outrageous harassing phone calls and they want $25k? I would highly stress looking up the office of the attorney listed on the paperwork (do not call any numbers listed on the paperwork itself), and contact them to ensure that the suit is accurate. Do not discuss settling or the narrative of facts/events, just confirm that they filed/sent the paperwork and end the call. This reeks of a scam.
NAL and just adding on since you’ve been given most of the information you’ve needed.
Take this situation as a lesson to get your proverbial ducks in a row when it comes to your son so that you can make life easier in the short term and the long term. Maybe check with a lawyer to get the finer details, but I mean anything necessary like paperwork, diagnosis, his disability being recognized by the state so he can qualify for aid, etc.
As you’ve said, you’re in a tough financial situation. You need to apply to or get what aid there is available to you to ease your burden for the present and future.

Even if this is real, itÔÇÖs sounds like your son is judgement proof. And thatÔÇÖs assuming he is even culpable for his actions. You canÔÇÖt get blood from a stone.

You will have to hire a lawyer unfortunately
Not an attorney, but I was a paralegal for many years. Not currently a paralegal. This sounds like a scam. Was it filed in your local court jurisdiction? Most county courts have online case dockets that can be accessed by the public (in limited capacity, but usually enough to know if thereÔÇÖs an actual case and named plaintiff/defendant). IÔÇÖm not sure what your local statutes cover as far as harassment, but here in Illinois, and I imagine many other states are similar, harassment is typically handled through a police report. If that doesnÔÇÖt resolve the issue, a complaint can be filed seeking a protective or no/contact order. If the harassment continues beyond that after a protective/no contact order is in place, there would be a warrant issued for the offenders arrest. They may be fined at that point or face jail time, depending on many factors.
I kind of donÔÇÖt think one night of shitty phone calls really warrants harrassment either. Not $25,000 worth of damages either. Personally, I think it sounds super scammy to be filing a civil suit for $25k when the person should have just made a police report. If a police report didnÔÇÖt stop it, they could have asked for a no contact order. Weird they jump right to ÔÇ£I want $25k in damagesÔÇØ. Even if this is a legit case and crazy person, I doubt theyÔÇÖre getting anywhere with a $25k civil suit with ONE night of phone calls, no continuing phone calls since the , no police report, and no attempts for a no contact order.
Its prob a scam he would be served paperwork or mailed paperworl if he were actually being sued, next time

> Im confused, scared, and lost on what to do next
You need your own attorney. This smells like a scam. This person has to have damages to make any kind of a claim.
Contact legal aid for assistance there.
I would look at a grandpad for him since there are mental facility issues. My wife works with persons who have had traumatic brain injuries and this is given to them for communications.
IÔÇÖm not mentally disabled and I have been sued twice for the sum of 10k total. I have little income and little assets and nobody ever tried to even collect. Went to court, lost, and that was the end. Not saying thatÔÇÖs everyoneÔÇÖs experience, but if you donÔÇÖt have anything to give they canÔÇÖt take anything.
Since OP provided the phone for the claimed harassment, could OP have liability for the sons actions?
Sounds like a scam

This is a scam

A lawsuit for $25,000 sounds like a scam. It is not worth the lawyers time, especially if itÔÇÖs taken on a percentage basis.
Might be a scam sounds like it.
