I’m a little confused. Is prison time worse than the registry? To me it’s the other way around. I would rather spend 20 years in prison than ever have to register. Prison was easy. I’m a Florida RSO. Simple battery isn’t a registerable offense. You need to find out the exact charges. You should be able to look it up on the court’s website. If it is Lude & Lascivious of any type, then it is registerable.
Now that depositions have happened, your attorney should have a feel for your chances to win. If the State comes with any lower offer, they know they have a good chance of losing. I’m not an attorney, but if that were to happen to me, I’d might offer something that gives the State a win but isn’t the worst long term. For example: Wilful Child Abuse, no registration, adjudication withheld and 2yrs of probation with early termination after 1yr clean. That means after a year of probation and doing what you are supposed to do without complaining, you get off and the conviction is off your record.
Note some counties are tougher than others. Hopefully you are in Orange/Osceola, Volusia or Tampa area. You can make better deals there.
