He cannot just be kicked out if his name is on the lease. He has the right to live there too.
Please do not lie to police to get an AVO out on him. Lying to police for your own benefit is highly illegal.
My suggestion is to just move out if you are both incompatible with each other. Maybe look for cheap rooms in share houses?
Maybe. Impossible to tell without more information.
Not to be unsympathetic but why doesn’t your sister in law move out herself.
He has just as much rights to the property as her. Unless there is violence etc
Only if there is domestic violence and an order is granted.
Otherwise they both have the right to stay there.
Practically if the ex won’t leave, your sister in law can break the lease with notification to the real estate agent and then move out.
Generally, you can’t kick someone out when they’re on the lease.
HOWEVER, if there is domestic violence then there are some exceptions. A DV protection order can state that a person is not able to attend a residence or have contact with a person – even if they’re on the lease or own the property. Get some advice from police or a DV support organisation.
If you’re on the lease on the same terms as the other lease holders you have the same rights and they can’t force you out except by court order for violence etc.
Yes for sure.
Typically get Court orders, eg. In nsw an ADVO .. When its domestic, she can talk to advo police officer for her area and the police get the order done

Of course. But you need a reason to do so. A landlord can breach a tenant for things like not paying rent amongst others.
If it’s a partner then you’d need there to be grounds for a protective order. But don’t lie to get one. There are either grounds or there aren’t. If there aren’t then whoever wants to leave the other should leave the property. The consequences for lying can be quite significant. Particularly for future claims there is an instant issue with credibility if one party has been caught lying to get an outcome.
