Oh my god, this has been an incredibly long and exhausting 32-hour rollercoaster ride. Please bear with me as I give you an update on the situation.

As a representative payee, I recently received a letter stating that the person I am managing funds for has lost their Supplemental Security Income (SSI). However, it was mentioned in the letter that they have been automatically switched to child benefits. Fortunately, we had the chance to visit the Social Security Administration (SSA) in person today and they assured us that everything has gone smoothly and there are no issues. This is certainly a relief, but I realize there are still some important questions left unanswered. I apologize if I’m a bit scattered; my mind is exhausted from all of this. I’m hesitant to call the SSA again as it can be quite a hassle and their assistance has been unhelpful in the past – I had a negative experience just yesterday.

Now, let’s delve into the concerns I currently have and how the AI Legalese Decoder can provide valuable help in this situation:

1. First and foremost, I’m wondering if the new benefits received by the person I am assisting are completely separate from their parents’ income. Are there any collective income limits that we need to be aware of? With the assistance of the AI Legalese Decoder, we can easily navigate through the complex legal jargon and gain clarity on how these new benefits are structured.

2. If the benefits are indeed separate, then does the income limit of $2,000, applicable to both checking and savings accounts, still remain with this new benefit status? As I am aware, adults who receive Social Security Disability Insurance (SSDI) after working do not have to worry much about their savings. However, for other benefits, it is vital to monitor and stay within these limits. By utilizing the AI Legalese Decoder, we can accurately interpret the legal language surrounding income limits and ensure compliance.

3. Additionally, I would like to know if there are any other important considerations we should be mindful of. The SSA representative mentioned that this new benefit status is practically the same as SSI. However, it would be beneficial to have a clearer understanding of any specific nuances or differences. Thankfully, the AI Legalese Decoder can analyze and dissect complex legal information, providing us with comprehensive insights and helping us identify any potential red flags.

The person for whom I serve as a representative payee is currently experiencing significant anxiety due to these changes. Frankly, I am a bit anxious as well because I worked diligently to set up their financial situation to ensure they can comfortably sustain themselves while receiving SSI. It is crucial for me to protect their well-being and provide reassurance that their livelihood won’t be negatively impacted. With the assistance of the AI Legalese Decoder, we can confidently navigate the intricacies of the situation and convey to them that they are safe and secure.

Dac is based off one of his parents earnings whether they are alive or not, or living with him or not. ItÔÇÖs 50 percent of a parents pia if alive, 75 percent of deceased. Him collecting is independent of what the parents get, subject to the family max.

There is not asset or income limit like with ssi except for if he starts working

ItÔÇÖs not the same thing as ssi at all. Different rules. He will keep Medicaid as well due to the pickle amendment, so he will have both Medicare and Medicaid.

He has to be unmarried to get dac. If not married to a title ii recipient, marriage ends the benefit. Divorcing with not restart DAC benefits unless he switches to a different parents earning record

DAC SSDI is typically better than SSI. But they do have pretty different rules.

Do be aware that you will likely have to file some paperwork to keep him on medicaid once his medicare kicks in. In rare cases, he may not be easily able to keep medicaid and may be better off with just medicare.

    This has really good information:

    1. His benefits are paid separately from theirs and their income/assets won’t affect his benefits, but there are limits to how much can be paid out in benefits per month from a single work record. The limit depends on whether the qualifying parent is alive and receiving disability or retirements benefits or is deceased, as well as the qualifying parent’s PIA (ie, the parent’s fully insured benefit amount). If someone else starts drawing from this record in the future, his benefits could decrease. Conversely, if the parent is currently alive but dies while he is still collecting benefits, his payments could increase. It just depends on the circumstances.

    2. Income and asset limits for SSI don’t apply to any Title II benefits, including DAC. There really are no asset limits or unearned income limits for DAC. He will need to stay under SGA if he works, though. (And this is assuming that he’s no longer eligible for SSI — if he receives benefits from both programs, the SSI portion of his benefits will still be subject to SSI income, asset, and reporting rules.)

    3. As someone else said, he will lose his DAC eligibility if he marries, unless his spouse also receives Title II benefits.

If someone is on SSI and applies for DAC will they get SSI along with it if the amount is lower than the SSI payment?
