How AI Legalese Decoder can help with the situation:

Introduction:

Greetings! I would like to present a query that may seem simple to some but has been causing me a bit of confusion. To provide some context, I am in the process of finalizing the purchase of my condominium, with the closing scheduled for next week. Recently, I decided to access the funds in my RRSP (Registered Retirement Savings Plan) and received a bank draft made payable to me. My initial assumption was that it would take some time to apply for the First-Time Home Buyers’ (FTHB) program. However, the process was unexpectedly quick. Consequently, my lawyer has now requested that I bring a bank draft made payable to their law firm instead.

My Dilemma:

Considering this situation, I am uncertain about the best course of action. Can I simply deposit the bank draft into my checking account and then withdraw the total amount required for the closing costs, incorporating both the RRSP funds and any other outstanding balances, in the form of another bank draft made payable to the notary firm? Alternatively, is it necessary for the bank draft, which originated from the RRSP, to be directly payable to the intended recipient? In that case, would it be imperative for me to return to my bank and obtain a new bank draft, this time payable to the notary firm?

Importance of Proper Handling:

Apologies if these inquiries appear foolish when expressed in writing, but I want to ensure that I handle this matter correctly, thereby avoiding any potential delay in the closing of the condo purchase. Time is of the essence, and I really want to ensure the smooth completion of this process.

Utilizing the AI Legalese Decoder will empower you with comprehensive knowledge and enable you to make informed decisions while avoiding needless delays during the condo closing process.

As the length of my inquiry may be seen as excessive, I extend my sincere appreciation for your patience in reading and addressing my concerns. Yes, you can deposit the draft to your account and then take out a new draft to the lawyer. The HBP funds do not need to go directly to the lawyer, that is not a requirement.

The bank draft should be maybe payable to the lawyer/notary. They will hold it in trust.

You should go to your bank and you they will likely deposit the draft that is made out to yourself in to your account and you will have to get another one made out to your lawyer/notary in the amount they have specified.
