## Child Support Situation in Florida

#### Background:
My husband and I recently relocated to Florida to be closer to his children, who have been living with their mother for the past four years. Previously, his ex-wife had full custody of the kids, with us only having visitation during summers and Christmas break. Despite the change in custody arrangement to 50/50, we have continued to pay child support as per the original decree.

#### Current Dilemma:
Even though my husband’s income has increased, we have not modified the child support agreement to reflect the new custody arrangement. The existing decree still mandates that we have the children only during summers and Christmas. Given the change in circumstances and the fact that we now share custody equally, we are unsure whether child support should be reevaluated.

#### Financial Situation:
My husband earns approximately $80,000 annually, whereas his ex-wife does not currently work, either by choice or through unreported income. We are uncertain about her financial status and how it may impact child support calculations.

#### Potential Actions:
1. **Reevaluating Child Support:** It is possible that child support may need to be adjusted to reflect the new custody arrangement and the income disparity between my husband and his ex-wife.
2. **Decree Modification:** Considering that we now share expenses equally and have a 50/50 custody arrangement, it may be prudent to revise the existing decree to accurately reflect the current situation.

#### How AI Legalese Decoder Can Help:
The AI Legalese Decoder can assist us in understanding the legal implications of modifying the child support agreement and decree in light of the new circumstances. By analyzing relevant statutes and providing guidance on the best course of action, the AI tool can help us navigate this complex legal situation effectively.

You’re not doing true 50/50 until it’s on paper through the courts. Have you had this new 50/50 for 6 months or longer? Don’t have emails or text messages proving it? Before you change child support, you need to change the custody agreement.

If you ask for a change in CS first, she can deny that you guys are doing 50/50 and they’ll go off the current custody agreement in place and if your income has increase you will owe MORE.

Get your ducks in a row before changing support.

First change the custody order. Secondly, if you request a review it can go up, down or stay the same and there is no way to know until the review is completed. He may get a little bit more credit for having more time but still end up paying more because of the increase of income. If the order is not from Florida it will also have to be moved to Florida for jurisdiction.

Support will go up. 50/50 doesn’t make child support go away. 50/50 has so many different schedules. Florida has time sharing. My husband moved back to Florida to be close to one of his children and a judge allowed us to go off fl child support. I pay for parties and anything extra. He wouldn’t pay for anything when we were together but you should definitely keep receipts of helping with extra things. His obligation may be lowered

When my husband and I paid an attorney to update his current order they told us the child support has to be updated at the same time. Both parties had to send in their financial documents.
