    How was the title set up? 50% for you, and 50% for them? In that case, your ex (assuming you were married) may be entitled to 50% of your share, and neither of you is entitled to any of the in-laws share.

    You should probably speak to a family law lawyer. I know you say you can’t afford one, but can you afford NOT to have one, if you’re talking about 50% of your home’s equity?

    If the PP was something like $600K, and it’s worth $700K today:

    * Your ex gets up to 50% of your share of the $100K capital gain, if that appreciation occurred while you were married
    * You get up to 50% of the net equity of the original value of the property, since you’re 50% owner, unless your ex contributed some of the down payment.

    It’s not up to your former MIL to decide who gets what.

    1. It isn’t up to your in-laws to split assets. That is between you and your ex (and the law). Unfortunately it is up to you to step up and protect yourself by getting/paying for your own lawyer.
    2. Your in-laws share if the home belongs to them. It doesn’t belong to you or your ex and has nothing to do with your split/division of assets.
    3. Your share if the home, unfortunately, is a marital asset/marital home and will almost certainly be split accordingly.

    since you’re already divorced, the housing issue would have already sorted out during the process no? Assuming you got half of everything including the house, resulting in your ex getting more of the remaining assets to balance it out. The 50% you own in the house when it’s sold should be yours alone

    NAL, but I’m fairly certain the lawyer handling the transaction can’t simply decide to give the money to someone other than the people on title. Unless the sale of the property and distribution of the assets is part of a divorce settlement, the lawyer needs to give you your money and leave it to you to distribute it if required. The only thing they might be able to do is hold the money (or at least half the money) pending settlement of the divorce – but I don’t think that can be on your MIL’s say so.
