Leaving a Co-Tenancy and Lease Renewal Complications

Background

Hello everyone, I’m a South Australian renter reaching out for some guidance on the best course of action. After giving notice to my real estate agent (REA) and housemate regarding my intention to leave the co-tenancy, I’m now dealing with the uncertainty of what happens next.

Initial Notices

To start, I want to confirm that I:

• Notified the REA and housemate of my decision to move out (and, by extension, have no interest in renewing the lease)
• Sent the required notice to terminate the lease through form 4B, with more than 30 days’ notice

Lease Renewal Complications

Despite my initial notice, the REA forwarded the lease renewal to my housemate, which they subsequently signed. This has made me the co-tenant, meaning I’m now listed as a party to the lease renewal. I’m at a loss for what to do next, unsure of how to proceed while ensuring my rights as a renter are protected.

Options Going Forward

Given the situation, several questions arise:

• Do I have any grounds to contest the renewal, considering I gave adequate notice before the lease renewal was sent? Can I argue that it voids the renewal?
• Assuming the renewal is valid, do I have any options to negotiate changes to the lease or terminate my tenancy early?
• What are my rights and responsibilities as a tenant, given the current situation and the signed lease renewal?

I’m not sure if you are on the hook if you haven’t signed but could you use the form – “change of tenant/resident”? This will get you off the lease but also assigns your interest in the bond to the other person. You would have to work out the bond between you and your co-tenant.

My advice on the post you made yesterday still stands.

You need to get transferred off of the lease or assign your place to new person approved by the REA. If a new person takes your spot they have to pay you your share of the bond before they are signed on.

The REA has butchered the situation by not giving correct or helpful advice but you and your housemates failure to communicate started it off.

The form 4B is used to end the tenancy. It’s not applicable for you to move out and your housemate stay on.

It’s a rental crisis, finding somebody should be fairly easy.
