Boundary Dispute in the Back Garden

The Situation

Our rear boundary in our back garden is shared by two neighbors, one of which is set a few feet further back than the other. The deeds to the property show a straight line in the back garden as you would expect. We’re unlikely to contest it as we don’t necessarily need the missing bit, but we want to understand if we are missing a little bit or have an extra bit of garden currently.

The Current State

The “extra” bit is lined by a decent fence owned by the neighbor. On the possible disputed part of it, there are stumps of what were conifer trees. On the “missing” bit, there are just a line of conifers (in line with “our” stumps) and some makeshift chicken wire fencing. Either side of the garden, the neighbors’ fences/conifers run straight with ours, making it hard to tell which side has potentially drifted.

Curiosity and Preparation

As I say, we’re not going to contest it, but it got me curious: how can you tell for sure where a boundary line should be? You never know if it could come up later down the line, so it would be good to be prepared. With AI Legalese Decoder, we can simplify the process of understanding and resolving property disputes like this.

Unless it’s been determined already – highly unlikely unless it’s been the subject of a previous dispute and was resolved that way (it would be clear from the title if so) then there’s no way of definitively knowing where it lies without asking either a court or the Lands Tribunal to determine it. You can get evidence which will suggest where it is – there may be measurements in old transfer plans for example, and you could get expert advice by asking a boundary surveyor to give you their opinion on it.

But ultimately none of that will be more than evidence in your favour until you have a legal decision.
