    US courts have largely held the police do not, in fact, have a duty to protect and serve any individual citizen. It is virtually impossible to sue them for “not doing their job as well as you would have liked them to”.

    Police don’t write reports for purposes of civil court. Police respond to, report, and take action for criminal law violations.

    Your losing in civil court has absolutely zero to do with the cops actions. Their job is not to help you with a civil action.

    Cops also don’t have a duty to protect and serve. That’s an old trope from LAPD. Cops respond to crimes.

    While you have every right to obtain a lawyer and file a lawsuit, you’re very likely just wasting time and money on this.

    Do you know if the officers were wearing body cams? Not all Philadelphia police districts are required to wear them but if those officers were wearing them, maybe the footage would be something your lawyer could request and you might get lucky. Short of that, it seems like it would be an uphill battle that would be tough to win. Good luck, though…

    NO police swear to “serve and protect”. That’s a popular fallacy because it’s the motto of the Los Angeles police, and so all the cars in TV and movies generally have that motto on them. Police have no legal duty to either serve or protect.

    As for what they put in their report: they are people, they make the same mistakes people do, they probably go two wildly different stories and wrote an opinion based on that. Regardless, you are taking this way too personally, you are never going to get the satisfaction you want, your only realistic option is to move on.
