    Plan on the whole day. Dismissals or reschedules are first, then easy ones where a resolution has been agreed on, then trial ones. Guessing this is criminal and he is trying to get the charge reduced or withdrawn

    This was around 2008 so things could be very different, but I had to testify in what I think is now called “Provincial Offenses Court” about a situation very similar to yours, where another driver went through a red light and hit my car while I was driving it.

    It was a pretty intense collision. Both cars were write-offs. At the time the other driver was apologetic and their teenaged passenger ended up going into shock so I had to administer first aid for them and give them a blanket out of the trunk of my car. They sent a nice letter later not addressing the crash but thanking me for looking after their daughter. I only share this to really underscore how ANGRY I was when I found out they were fighting the ticket for running the red and I was being subpoenaed to testify about it!!!

    Anyways, on the day of the trial it wasn’t in and out, I was there several hours. There weren’t any uninvolved witnesses, just myself and the police officer who attended after the crash. It’s a bit fuzzy 15 years later but I was invited to recall my version of events. The defendant pretty much testified “I am a good driver and wouldn’t drive through a red, therefore the light couldn’t be red”. I testified that I was watching the cross-direction lights, saw the walk indicator change to don’t walk, watched the light go yellow then red, then my light went green, I advanced, the other car hit me half way through the intersection and were going fast enough I couldn’t do anything to evade. The office could only really speak to the situation after the accident, testify which parts of each car were damaged etc.

    This was not criminal court and a decision was made on something like “balance of probabilities” rather than “beyond a reasonable doubt” (I’m not a lawyer, I’m sure those are not the correct terms). Anyways, the judge convicted the other driver, basically saying they found my testimony more persuasive and credible.

    So show up. Recall things as well as you can. Tell the truth. Try not to exaggerate or embellish the story. Be respectful of the lawyers and Judge. It’s mostly out of your hands, but do your part as well as you can.
