The Unexpected Attack: A Delicate Situation

The Incident

My husband works for a large delivery company, and while handing a package to the owner at their doorstep, their off-leash dog tackled him from behind and bit the back of his upper thigh. Although it didn’t tear his thick work pants, the dog’s teeth still punctured his skin, and his pants acted like a barrier. He was bleeding and shocked, and the owner proceeded to close the door and run, leaving him with the still aggressive dog.

The Consequences

He managed to escape without further bites and drove down the road to call his manager, who filed a police report. The police took my husband’s statement over the phone, and public health became involved. However, the owners refused to answer or return phone calls, would not answer the door for public health’s multiple physical visits, and will not respond to any form of contact.

The Emotional Toll

My husband is now missing work to get a series of rabies vaccinations over 14 days, plus he already missed two days for wound assessment and a tetanus shot. This is on the advice of public health and his physician. He is stressed and frustrated by the situation, feeling that there are no consequences for the dog’s attack and the owner’s lack of responsibility.

My landlord’s dog bit a stranger that came on to the property & the victim sued her for the maximum of her home insurance. Maybe a route your husband could look into.

If he was injured while working, you should probably look into a WSIB claim.

Otherwise it seems like you have what you would need to commence a lawsuit for the injury. Dog owners in Ontario are generally liable for injuries caused by their dogs, and this is likely the sort of case you could have someone take on contingency.

“Doesn’t want the dog put down”. Adult male thigh level is a child’s face level …. Think about that!

Push the police to act if they haven’t. They have sweeping powers that go beyond shrugging their shoulders if the owner doesn’t respond.

If they don’t, you can politely ask them if a complaint to the OIPRD is required.

This happened to my husband too. Except that the dog was surrendered tested and returned to the owners in about 9 days. My husband had a few deep puncture wounds on his hand. Luckily for him the dog did not have rabies but had not been vaccinated either. The humane society in my local area vaccinated the dog and said no more doggie unless you pay bill please, they also quarnatined the dog and tested him for all that ails them and waited til those results came back. In the meantime the health unit created a file for my husband and had contact with him every few days to see if he had any symptoms or possible infection in the puncture wounds. No he did not. But now he is afraid of dogs. He never was before but he is now. So he quit and started working somewhere else that he will not have to encounter dogs. Keep this in mind for your husband moving forward. If he needs to work in a different career track due to workplace ptsd, and yes its a thing, EI will support that with doctors support. EDIT to add, EI will require medical documentation and will even pay for him to go and retrain for something else.

Make sure you hound the cops to follow up. They can’t dodge the cops forever. In addition to finding out the info in whether the dog is vaccinated, etc., the cops should be charging them with criminal negligence causing bodily harm.

The upside to your situation is that you know where the owners live. My daughter was bitten a couple of years ago and the bitch owner took off with the dog.

    Sue them. Period.

Every dog owner should have a very clear understanding of what “strict liability” means.

Call a lawyer that specializes in dog bites (PM me if you want a recommendation). Also start documenting everything, and while it’s still fresh in your mind write down the details of the dog bite.

Fuck those dog owners. Get a lawyer.

If he’s provided a report to police, then it’s already in their hands to act; whether that be a warning or ticket or something more.

Missing work and/or reduced duties will be handled through the WSIB file that he has opened when reporting this to them.

The owners not answering public health or bylaw or police is between them and the authorities, no need for you guys to worry about that part

I am so sorry this happened to your husband. It is important to contact your city about the attack. I believe most municipalities have 311 or a contact number like that. Their animal services group will (or should) go to the owners to find out vaccination status and may even give a fine or seize the do if there is a history of this behaviour. The city should follow up with you with what they find but you should also be given an incident number when you file the complaint to contact them.

NAL but work with one and used to work in insurance. You cannot profit from insurance and will only be compensated for up to your set maximum limit. You were injured while performing your regular duties at work so therefore any compensation you will receive may fall under any work provided or related insurance or benefit such is WSIB or company disability. Anything in excess such as future or foreseeable related disability as a result of the dog bite you may need to sue for.

    Edit: additional info

The police will deal with the dog owner about the dog itself. They may quarantine and make recommendations such as euthanizing the dog if necessary.
