    You need to make your light duties and return-to-work process as formalised and documented as possible, and prepare anything that might be needed to refute performance management if it comes to that.

    Dismissal for absence due to prescribed (i.e med cert) illness or injury gives rise to a general protections claim IF the absence is less than 3 months. A legally aware employer will remain in regular contact if needed to keep on top of recovery developments and will send you warnings that waiting for your return is too much of an operational burden and will give deadlines to return.

    Dismissal for absences longer than 3 months can go through the unfair dismissal process although that‘a much more dependent on your recovery trajectory and the burden on the employer to wait.

    Provided its not a workplace injury, if you can’t perform the inherent requirements of your job, you can be terminated. Is there anything that could assist you to do you job in the interim? If so, you could see if your employer would make some reasonable adjustments to enable you to keep working.

    As far as the working goes, if you can do the work, there should be no issue. If you need to work less or slower, you may be able to get lighter duties signed off on, or reduced hours may come with less pay. If you can’t do the work, then you use sick leave, unpaid leave or there may be options to let you go (ie if you use too much unpaid leave).

    As far as time off/sick leave, it depends on how much you have and how much you use.

    Unfortunately the only other option I can think of would require pre-organisation – Employment insurance, that can pay you if you are unable to work.
