Situation Summary

A 25-year-old woman (the writer) experienced harassment from a 28-year-old man, who would often sit at a bar where she worked as a waitress from 23-24. The man never technically threatened her, but his behavior made her uncomfortable and she quit her job. However, he continued to stalk her, showing up at her doorstep two weeks ago and appearing on camera multiple times. The police told him to leave, but he did not physically harm anyone. The writer’s husband is considering confronting the man, but she is worried about his safety and potential legal repercussions.

You are allowed enough force to defend yourself, but not more. Your husband can’t beat the crap out of him. If he throws the first blow, he will get charged.

  • thehouseofyass

Yes, your husband would be in trouble. You’re not allowed to beat the crap out of people. You can only take whatever action is absolutely necessary to protect yourself from an actually occurring attack. Going out of your way to beat someone up does not qualify.

  • dan_marchant

Unless the guy actually attacked you or your husband or tried to force his way into the house … going out and hitting the guy (first) would be assault. Which is a criminal offence. (Especially if he left the safety of your home to attack the guy).

Just because someone does something wrong it doesn’t mean you get to break the law. If he comes to your house call the police.

PS sorry you are going through this. Stalking really is an incredibly nasty thing to do.

  • CommonEarly4706

I get you are scared and annoyed but your husband wants to just go and beat the guy up. You are seeing a lawyer and going the legal route, trying to get a restraining order. your husband just going and beating the guy up is something he could be charged for. he could also end up seriously hurting him. also doing this is giving the guy more reason to be involved in your life. Court appearances, possible lawsuits. Go the legal route and fighting someone is never a way to handle something. It never ends well

  • Pretty-Highlight-491

Okay confirmed my research and deleting, sorry this made you all mad I can’t control any of the situation and if I tell my husband what to do I have more to worry about then a stalker, which is why I’m confirming on Reddit to make sure I wasn’t misunderstanding (yes it might seem simple to you but I am stupid, I need confirmation on everything) and I wanted to make sure if I had to argue with him again about it I wasn’t saying stuff that wasn’t true
thank you though, going to a lawyer tomorrow so hopefully this just ends there and I don’t have to worry

  • ThisSaladTastesWeird

    1. Restraining order for the creep
    2. Anger management counselling for your husband

  • wabisuki

    Your husband.

  • VR46Rossi420

Your husband will most likely end up with a criminal charge. He can confront and scare him but any physical violence would be criminal. Now if he roughed him up and simple assault (like he hits him but doesn’t really hurt him too much or cause injury) he probably only get a slap on the wrist if even. But then again he could also end up with a criminal record so it’s a risk vs reward thing.

Also, what if this guy is now spooked by your husband and he decides to bring a knife or something for his next visit to protect himself and he ends up stabbing your husband or something like that. This guy clearly has mental health issues.

It really isn’t worth it at all, especially when it sounds like your husband has a lot more lose than this other guy.

  • jkozuch

    Your husband.

  • WestEasterner

Make a lot of his actions/interactions with you. Include anytime you’ve seen him when you ought not to have. Log him appearing at your door.

Now call police. Tell them that you **genuinely fear for your safety**.

Now you have the offence of Criminal Harassment, which is an arrestable Criminal Code offence.

  • tandex01

Have you told this guy to leave you alone and not t contact you?

  • Legal-Key2269

Document this stalking behaviour and report it to the police as many times as it takes for the police to take action.

Get the guy’s license plate number so the police can identify him. Alternately, if he has paid bills at your former employer with credit or debit, indicate such to the police and they may be able to seek those records to identify him.

Use your phone to check your vehicle/home for air-tags and other similar trackers that are not registered to you or your husband. If you find any, report that to the police. The police will be able to seek the identification of the tracker’s owner.

If you want the guy to incriminate himself, continue to record video of him knocking on your door or corssing your property line after being told to leave. Tell him (or have the police tell him) he is trespassing.

Stalking is a criminal offence. A restraining order will be easy to obtain, especially with security footage and the fact that police have attended your home and interacted with this creep.

Once a restraining order is in place, continue to document and report to the police.

You will definitely need a lawyer if your husband uses violence. Especially in a situation where physical harm is not imminent, and it will be worse as it sounds like you and he are premeditating violence. Chasing the guy in the street because he got out of his car very likely won’t be considered “self defence”.
