Title: Considering Out-of-Court Agreements: Finding Solutions with AI Legalese Decoder

Introduction:

My Daughter’s Decision to Move In with Her Mother and the Need for New Custody Arrangements

Since my daughter’s birth, she has primarily resided with her mother. However, when she was seven, I took emergency custody over concerns of abuse from her mother’s live-in boyfriend. Although these accusations were later proven unfounded, I retained physical custody with visitation rights granted to her mother every other weekend, while maintaining joint legal custody. Over the years, the details surrounding visitation and custody have become intricate but are not pertinent to my current inquiry.

Current Situation and Challenges:

Fast-forwarding almost 8.5 years, my daughter, who is now approaching sixteen, has grown displeased with the rules and dynamics in our household. Meanwhile, her mother has a plethora of activities and vacations lined up for the summer. Consequently, my daughter decided to move in with her mother and her boyfriend, intending to also attend school with them in the fall. I worry that once the “vacation season” ends and school resumes, she may experience regret. Moreover, my daughter has been displaying disrespectful behavior towards me and my long-term girlfriend of seven years, refusing to abide by rules and accept consequences.

Co-parenting and Exploring Alternative Solutions:

Despite the strained dynamics with my daughter, her mother and I maintain a civil relationship. My girlfriend and her mother also communicate regularly regarding parenting strategies, rules, and medication matters. Given the collaborative atmosphere, her mother proposed bypassing court proceedings and seeking a revision of the existing custody order from 2014 through a parenting plan agreement. This amended agreement would reflect the current circumstances, with essentially reversed roles and adjusted considerations for a teenager. Both parties would sign this agreement, have it notarized, and submit it to the appropriate court overseeing our current custody order.

Child Support and Potential Legal Implications:

Insights from AI Legalese Decoder:

In addition to the proposed changes in guardianship, my daughter’s mother suggests that I stop child support payments immediately. Instead, we would agree upon a fixed monthly amount privately, without involving the Domestic Relations agency in Pennsylvania. While I had initially intended to continue paying child support, this alternative arrangement seems appealing. However, I have concerns about whether resolving matters outside of court might expose me to legal risks. I would also like to understand any potential red flags that I should be aware of before proceeding.

Assistance from AI Legalese Decoder:

This is where the AI Legalese Decoder can prove beneficial. Utilizing this advanced tool can help assess the viability of reaching agreements out of court and mitigate any possible legal repercussions. By analyzing the specifics of your circumstances and relevant legal considerations, the Decoder can offer comprehensive insights and guidance. Considering the strained relationship with my daughter and the collaborative atmosphere between her mother, my girlfriend, and me, pursuing an out-of-court agreement appears to be a viable option. The use of AI Legalese Decoder can assist in evaluating the suggested parenting plan and child support changes while identifying any associated legal pitfalls. Ultimately, this technology will enable a comprehensive understanding of the situation, ensuring the best decisions are made for all parties involved.

Sounds like an ideal situation. There’s no need to get the state involved if you don’t need to. I was on this path and the mother started second guessing like you are and then hired an attorney and filed a petition in the court. She ended up throwing $15,000 on lawyer fees for us to mediate essentially the same agreement we would have come to had she not filed in court.

Yes it is wonderful to make agreements on your own. However, since you already have a court order, it is necessary to submit your agreement to the court. It should be super simple since you all agree on everything. A new court order will make it easier for mom to enroll her in school, etc.

Also, it is guaranteed that domestic relations will need a court order to stop momÔÇÖs child support payment to you. I think it would be acceptable for your new order to then state that you pay mom a set amount directly to mom (through zell, checks, whatever) and specifically state that the new order is not to be paid through or enforced by domestic relations.

IÔÇÖm in PA, but probably not the same county as you so this may not apply to you. In my county you can take an agreement to the court, the judge will sign off on it, then you file it together. There is no cost to modify an order and there is really no reason not to do it. It is always better to come to an agreement together, but it should still be filed with the courts. I donÔÇÖt receive child support so I canÔÇÖt really comment on domestic relations.
