    When you say 12 month contract, was this a position with a concrete end, or they just renew contacts annually?

    Regardless this sounds like a company firing a woman for being pregnant which is pretty hugely illegal, just a question of ‘did they lead you astray of your rights by convincing you to hand in a resignation’.

    You should most likely speak with an employment lawyer, but given that this is related to pregnancy the human rights commission is another option.

    As far as the EI, even if you quit, if you have enough hours to qualify for benefits and meet the other requirements for maternity you should get mat leave. Maternity benefits is a special benefit and the reason for sep doesnt matter.

    Feels to me like this is “messy” because the employer is being super shady. I would definitely speak to a lawyer for this.

    When you say 12 month contract, is it a fixed term assignment? Are you billing them as an independent contractor or receiving a salary? Because if you are receiving a salary, you are entitled to maternity leave. Whether you have a job to come back to may be up in the air depending on the wording of the contract.

    Was the few weeks you wanted off just for a vacation or break? That’s how I’m reading this. That you asked for time off unrelated to your mat leave and they said ‘no, if you want time off you need to quit’.

    There needs to be more clarification here when you say ÔÇ£I asked to take a few weeks off and returnÔÇØ – was this at the 5 month mark? Under what reasons were you asking for the time off – medical or just want to take a few weeks off? You can only start receiving EI 12 weeks before your due date, and take a maximum of 15 weeks maternity.

    If they asked you to quit because of pregnancy, then thatÔÇÖs an issue. However, if you asked to take maternity at 5 months, then thatÔÇÖs not possible (you can go off on sick leave though, or request accommodation due to medical issues, both with proper medical documentation). The pregnancy also doesnÔÇÖt impact your ultimate end date, unless itÔÇÖs something like a perpetually renewing 1 year contract (the courts have found that constantly renewing a 1 year contract creates an employer employee relationship with no fixed date, regardless of the contract).

    Not sure what org youÔÇÖre with, but where I work you cannot penalize someone for being pregnant, even on a contract. So when they go off on Mat leave theyÔÇÖre entitled to the standard EI time off (or less if you donÔÇÖt want to stay off that long) and when they return the duration of the contract would be completed. They have to provide you with a similar or better role/opportunity, nothing less.
