Victoria, like all states have a Financial Management Act which empowers them to pursue overpaymemts of public monies. This will also be covered under the relevant industrial agreement you were employed under. If you are still employed by the public sector they are able to setup deductions to the tune of 10% maximum of your average income per cycle. If you have terminated then it still stand as a debt you would be most likely held to unless you can convine them to waive it on compassionate grounds, (claim and prove financial hardships, humanitarian reasons). My advice is confim the details of the overpaymemt and organise a payment plan that is comfortable to you. Keep in mind they will also perform an income statement adjustment for that financial year which you will be able to submit to the ATO and get some money back for the difference of declared income.
