AI Legalese Decoder: Ensuring Consumer Rights in Misleading Bookings

Hey all,

I wanted to reach out regarding a recent booking I made through booking.com. I am currently in Sydney and had chosen a place that was explicitly described as “airconditioned” in the booking details. However, upon arriving at the accommodation, it seems that this claim was misleading, as there is no air conditioning available. This situation has caught me off guard, especially considering the expected temperatures of over 30 degrees Celsius this weekend, for which an air-conditioned space was my primary criteria.

Given this discrepancy between the advertised amenities and the actual facilities provided, I am wondering if I have any recourse with the Australian Competition and Consumer Commission (ACCC) or any other relevant organization. I believe that my consumer rights may have been violated, and I am seeking clarity on the matter.

In addition to exploring potential legal avenues, I am also interested in understanding if I am entitled to any form of reimbursement, considering the misrepresented information. A fair resolution would be greatly appreciated.

Have you got an air-conditioned room?

If no, have you spoken to the hotel and asked to be moved to one??

Seems like a giant leap to take rather than trying to solve the actual problem at hand.

If you booked through a third party, your beef is with them. Though the sites try their best to make you think otherwise, you aren’t actually a customer of the hotel, but of [booking.com](https://booking.com), who contracts with the hotels. Those websites are *notorious* for advertising features that don’t exist, not passing on room types/preferences/requirements etc. to the hotel itself, selling rooms even when sold out, and just generally being a pain in the arse to deal with. My understanding from what I’ve heard from front desk agents is they have zero power to alter a third party reservation like 95% of the time.

If you’re unable to speak to a front desk of any sort (and even if you can it would be more of a courtesy heads up than anything), you’ll need to contact booking and explain the situation. They’ll want to call the hotel directly (hence the courtesy heads up) to see if they can arrange another room. Since you’re having trouble, I doubt they’ll do any better.

The issue that can arise is that there’s a very real possibility that in the T’s and C’s there’s a bit that says “not all room amenities are identical, we’ve done our best to represent it, yadda yadda yadda.” While that may or may not *technically* give them a free pass on the no aircon, you’ll still have to fight that while figuring out what to do. If you walk before the hotel gives the OK, your chance of any refund is significantly diminished because booking will argue you left of your own choice, you weren’t “walked”, so any prepaid stuff wont be refunded.

In future, use those websites to shop around, but try to book through the hotel directly. Sometimes a little more expensive, but you get more flexibility and better info on amenities etc.

How do you know it’s not air-conditioned when you haven’t been in the room yet?

  • GCRedditor136

    > booked a place through booking.com. The booking clearly states the place is ÔÇ£airconditionedÔÇØ

Take a photo of the website where it states that, and/or save the web page in Archive.org or such. You may need this evidence later if you need to dispute.

If itÔÇÖs a hotel are you sure it doesnÔÇÖt have evaporative air conditioning and not a single unit? Just ask reception.

Usually air conditioners are central units and are operated by a therostat not a remote. Look for a walk panel

  • DiamondGlum556

You need to take that up with bookings.com thatÔÇÖs who you paid now your journey begins good luck with that

  • ArghMoss

Yeah Ive been burned on those sites before and so now I always try to book with the place directly.

If it is the case that it said air conditioned and it’s not I think you’ve got a decent argument for a full refund. It’s probably going to be a massive pain to get though.
