    Here’s the thing. It’s likely they aren’t at fault, but time and lawyers cost money, so they will accept a settlement now as it will likely end up costing them less in the long run.

    If you goto court, you will likely need to prove that they knew about it and were negligent in cleaning it up. For example, if a customer spilt the windex minutes beforehand, they couldn’t possibly be liable for it.

    If I were you, I would email them back saying you have sought some preliminary legal advice and would like to know what their offer is before you decide to fully engage with your lawyer.

    Even if it goes to court in Australia, you will not get a big payout for ÔÇÿpain and sufferingÔÇÖ we are not like the American system. You will get your medical bills paid and thatÔÇÖs it. If Medicare or private health cover covers part of it, you will only get your out of pocket. I am surprised the lawyer did not tell you this.

    Drop the lawyer and work with them directly. You wonÔÇÖt get much.

    You never reported this to the supermarket at the time of accident? Hopefully they still have CCTV of you fall and how long the windex spill was left there or if any employees walked over this and did nothing which would be in your favour. If my babies were involved I would have immediately made an official report got all their names and asked to be given a copy of any report. This would be a legal requirement under WHS laws. You were injured regardless of whose fault it may be in the wash. You need a lawyer in your corner – you never know the long term implications of this injury.

    The no win no fee lawyers actually charge the most. 50% if under 11k? Imagine if over 11k how much theyÔÇÖll charge not worth the hassle and years of mitigation

    What state are you in? You can definitely get General Damages (ÔÇÿpain and sufferingÔÇÖ) itÔÇÖs just a lot less than they do in the US and in some states the amount is scheduled (ie google ISVs if you are in QLD). ItÔÇÖs probably too soon to say if this will have an impact on your earnings when you go back to work so keep that in mind. What are you afraid of re litigation? Even if you do commence proceedings, the likelihood of seeing the inside of a courtroom is about 1%. No win no fee means no fee if the supermarkets insurer doesnÔÇÖt pay out, and any payout will have to be at least double the legal fees right, or it wouldnÔÇÖt settle, so as long as you have good evidence and no pre-existing youÔÇÖll end up with something in your pocket.

    Similar thing happened to someone I know but outside on the property of the shopping centre with a no-win no pay lawyer. It had lasting damages not being able to work full capacity.

    Your event sounds traumatic, but damages currently dont appear measured. Eg, currently not working, so no loss income hasn’t used sick leave. It’s probably not long enough to determine lasting damages. I think you have 5 years to work this out, but you need to go to the supermarkets’ lawyers’ chosen doctors. Weigh up the burdon of this whole process to return anything substantial is dragged out.

    As above, if they come back with a cleaning check sheet showing, the store was cleaned / checked for hazards at a reasonable rate. Or if it was reported by other staff or customers but no action taken youll have grounds. Eg the person 1 isle ahead of you may have leaked it unknowingly as they leave you go in. The liquid would of shown on ground. Your part to blame for not observing surroundings. If you seen the detergent and chose to walk on it. Risk on you. If it was hidden, then need photos and professional reports.

    In any of these situations, your account is biased and needs professionals and third-party reports. Witness statements.

    Consider all this and tally up the actual costs with receipts. If no future loss of income eg reduced hours due to damage to body. Its a long drawn out process id only recommend going through that angle if you know the payout is closed to 100k or more, which sounds like it won’t be.

    I recon theyll offer you $500 to cover the massages, etc. Just remember this is there game you go it alone you dont get as much as the lawyer. But is 5k with 1 + year of distraction and misery really worth it? Perhaps an apology letter and expenses paid for check ups yourself and baby for own peace of mind.

    i would get some quotes from different law firms. itÔÇÖs a hassle to re-explain yourself, however it may save you a bit of money in the long run. donÔÇÖt sign any client agreements until youÔÇÖre absolutely pleased with the fee structure etc. and there is always a right to negotiate reasonable fees when retaining a legal practitioner to represent you
