    Were those shares RSUs or PSUs? Were they tied to to benchmarks? Additional point – they definitely aren’t paid three years’ from vesting, they need to be paid three years from being earned, see 248(1) ITA or the CRA gets, euphemistically, quite annoyed. You may actually be entitled to more of them than you think.

    I was recently “restructured” from a large financial institution. Severance was for 6 months continuance pay while I sought remployment (I had worked there for 8 years). I sought legal advice and they felt I should be getting closer to 9-11 months. Went through the process with the lawyer. We countered and the FI didn’t budge. Quickest $5K I ever wasted.

    Sounds like you answered your own question. I am sorry that you are in this position. Working private sector is tough. My takeaway from all this is just to be a maniac with respect to my KPIs and just constantly seek better employment until I can retire. Best of luck!

    I thought severance was 1 week per year…or maybe that is just in BC.

    Unless one has really special skills I don’t know how you would argue for more than employment standards.

    Your RSUs will have a vesting date, after that date they are yours. You should be able to log into your account where those shares are located.

    Lawyer up, you are entitled to not just the statutory minimum, but should also get time in lieu of notice and another additional lump sum (probably a month per year) based on your director title and how easy it will be to find another similar job.

    Get an employment lawyer (some good ones in Toronto). They’ll draft up a letter for you for under 1k. Make sure they include their fees are to be paid by your employer in that letter.
