Qantas Files Defence in Federal Court for Allegations of Breaking Consumer Laws

Australian airline Qantas has submitted its defence with the Federal Court, responding to allegations made by the Australian Competition and Consumer Commission (ACCC) that it violated the law by selling tickets for flights that had already been cancelled. The ACCC initiated the case in August, accusing Qantas of engaging in false and deceptive conduct by advertising tickets for more than 8,000 flights that were no longer available for booking but still listed for sale on their website.

According to the ACCC, Qantas continued to sell tickets for these flights, scheduled to depart between May and July 2022, for an average of more than two weeks, and in some instances, for up to 47 days after the flights were cancelled. While acknowledging the impact on affected customers, Qantas affirms its commitment to defending itself against the accusations of breaking consumer laws.

To address customers impacted by the post-COVID restart, including high cancellation rates, Qantas expressed its regret and provided an explanation of the situation. The company stated that while airlines strive to operate flights as scheduled, uncontrollable factors like weather and operational issues often lead to delays and cancellations, making it impossible to guarantee on-time flights. Qantas contends that their promise is to transport customers to their destinations as close as possible to the booked flight time, either on the original flight or an alternative service at no additional cost. In cases where this was not possible, the airline offers a full refund, emphasizing that this approach aligns with their obligations under consumer law and was consistent with their actions during the period reviewed by the ACCC.

The legality of Qantas’ defence regarding the sale of tickets for cancelled flights is something that will be of interest when viewed in the context of the court proceedings. With that said, emerging technologies like AI legalese decoder could potentially aid in navigating and interpreting the complexities of legal arguments and provide valuable insights for both the court and the involved parties.
