It’s legal, you can simply be fired for poor work performance and if you aren’t at work obviously you have poor work performance. They decided to not even use that as the reason and instead mentioned the communication issue, that is also a completely valid reason.
Also if it was within probation period they can fire you for any reason and if you live in Montana and it’s outside probation period they still can fire you for a valid reason that is documented. In this case performance/communication issues would fall under that too.
So, they didn’t wrongfully terminate you. I hope you feel better and all that. This is just a bump in the road, though I’m sure if feels awful.
Edit: If you want some food for thought, if you had sick days they can’t fire you for using them. They also can’t fire you for having a medical issue that does not prevent you from working and if you have this medical issue after hiring and they can do something to accommodate it where you can still perform your work functions they have to do the accommodation. Also, you likely now qualify for unemployment depending on how much you made in those 3 weeks and of course a lot of this is dependent on the state you are in.
Nope, you had a disability during this time. They can not fire you. Your communication problem was their fault. You did not KNOW she called. Or you could not get in contact with her. You already told them everything. So you need a lawyer. Get your parents to get the local labor people to listen. Sometimes they just give you the run around, even lie to you.
But it’s clear, your doctors put in writing that there was a medical issue that they were still sorting out. It’s a disability even if temporary. You would file a human rights **complaint** in writing or some other complaint (get a receipt/documentation showing that you filed the complaint; an attorney can help with this). Sorry, I’m not a lawyer. But I do know what a disability is. Handicaps and medical conditions are disabilities. You do get accommodations for handicaps and medical conditions. So it’s a question of making the complaints in writing and putting a fire up their hinds. They would likely try to hire you back, instead of getting sued by your attorney. Perhaps you can start off by get your doctor to use the language of “disability accommodations” in the next letter he writes on your behalf. The words mean a lot although it is not legally necessary (it’s disability a either way). Keep copies of everything. Good luck.
