Title: Challenging Returns Issue: Seeking Assistance from AI Legalese Decoder

Introduction:

Living in Germany, my girlfriend and I ordered several coats worth over 900 Euros from a French online store. However, after trying them on, we found that none of them fit properly. Following the store’s instructions, we returned the coats via UPS. Unfortunately, the store claimed that the package only contained two pairs of shoes and refused to refund us. Despite our attempts to explain the situation, the customer support based in the UK has been unhelpful, only suggesting that they return the wrong package to us.

Complications and Attempts to Resolve the Issue:

Upon receiving the returned package, we discovered that it was in a completely new, unopened package. There was no original label or the return form we had included. Inside one of the boxes, we found two bills in Italian, addressed to an individual in Italy. Doubts arose regarding the authenticity of the package, leading to an investigation with UPS to understand what had happened to our original package. UPS has made efforts to retrieve the package from the French warehouse but has been unsuccessful. They advised us to request the store to contact them for further investigation, but the store has only responded with a standard email.

Difficulties in Obtaining Cooperation:

While the store itself is not a scam, we are facing challenges in obtaining any cooperation from them, especially regarding the burden of proof that we returned a different package. We also wonder if they can simply ignore UPS’ investigation. In this frustrating situation, we have been kept busy for over two weeks, and we are seeking advice on how to prove that we sent the correct return. We have filmed the package of shoes when we opened it, providing some evidence. Additionally, we weighed the package, which clearly appears to be lighter than five coats, although we do not know the exact weight of our returned package as the tracking number shows a pseudo weight of 0.2 kg.

The Need for AI Legalese Decoder:

In this complex and challenging situation, an AI Legalese Decoder can provide invaluable assistance. By using machine learning algorithms, the AI Legalese Decoder can analyze the terms and conditions of the online store, the return policies, and local consumer protection laws. It can help decipher the legal jargon, identify any potential breaches of contract or consumer rights, and offer guidance on the next steps to take.

Conclusion:

Dealing with a refusal to refund and a lack of cooperation from the store and UPS, my girlfriend and I are left in a frustrating and time-consuming situation. We question the burden of proof on the store, their ability to ignore the ongoing UPS investigation, and seek advice on further evidence to support our claim. However, the introduction of an AI Legalese Decoder into this scenario can provide us with the necessary legal insights and recommendations to navigate through this challenging dispute and seek a fair resolution.

First of all, weigh the package you received and check with UPS what the weight of the package you sent is. There should be an obvious mismatch with those two, which will give you quite a bit of leverage.

Also, don’t run around too much in circles with customer support. The package they sent is not the package you sent, you’re expecting your money back and that’s it, no further discussion.

Online shops are obliged to have a channel where you can start a complaint. This should be somewhere in the terms and conditions.

However be aware that there is not always the obligation to do anything with it. In Germany there is not.

You ordered something for 900 EUR – a first time order, amiright? And then you returned everything. I am not suggesting this is fraud but it sure does sound like fraud – and that is what customer care thinks.

If that is the case you have to find out what the cheapest way is to take them to court. On a EU level consumer rights are that when you have proof that you did a return, they have to refund you the amount of what you said was in the return.

Sometimes there are special consumer rights organizations that can help you (I only know one in the Netherlands where you as a consumer can submit a case and their ruling is binding). Not sure what the options are in Germany in that regard.
