Title: AI Legalese Decoder: Understanding the Legal Implications of Trespassing and Public Drinking

Exploring an old abandoned pub with my friend turned into an unexpected encounter with the authorities, leaving us with numerous unanswered questions about the legal consequences. In this article, we will delve into the legality of trespassing and public drinking, while exploring how the AI Legalese Decoder can provide valuable insights to help shed light on such situations.

The Incident:
After an unsuccessful exploration of the abandoned pub, my friend and I decided to relax in its car park – an open concrete space adjacent to the pub, within the enclosed land. Little did we know that surveillance cameras were watching our every move as we indulged in alcoholic beverages. Within a mere 10 minutes, two police officers arrived at the scene and approached us with inquiries regarding our identities.

Trespassing: It is crucial to understand that trespassing is generally considered a civil matter, especially if individuals willingly leave the premises upon being asked to do so. Public drinking is not illegal *per se* in England and Wales. However, local authorities have the power to make Public Space Protection Orders over areas within their authority, and breach of such an order is a criminal offence. The Orders can say practically whatever the Council want it to say, and I’ve seen lots of them used to prohibit drinking in public.

I would need to know firstly whether there was a PSPO in place, and secondly the precise activity it prohibits, to ascertain whether or not you’d committed an offence by breaching it.

A “public place” can (and ordinarily does) mean any place to which the public at large has access – private car parks can be “public places”. But if you were trespassing, that does rather suggest that the officers thought that the car park was not open to the public at large – so yes, it may well be a contradiction to accuse you both of breaching a PSPO and trespassing at the same time.

    > 1 am aware that trespassing is a civil matter unless we refused to leave the premises

Trespassing is a civil matter, but you don’t need to be asked to leave before you’re trespassing. If I enter your house through an open window and stand in your bedroom doorway, I’m already trespassing, even if you’re still asleep and haven’t asked me to leave yet. If the pub was closed, you probably were trespassing from the moment you entered its grounds.

You realise that ANYONE can request your name, right?

There’s a big difference between being asked vs a requirement to provide.

Straight from the met police website.

“Trespassing is not classed as a criminal offence. In most cases, this is not a matter for the police. We’d recommend the first thing to do would be to talk to the people occupying your land and ask them to leave, if you feel safe to do that.”

    NAL but former police officer.

You have nothing to worry about. Your names were taken to be run through the police computer to check you out. At most, they’ll write a report saying they spoke to you. This is in no way shape or form a criminal record – it’s simply a record of what the police did and that’s it.

If they didn’t do anything at the time, nothing will come of it. What did they say to you?

Quite a funny response tbh as that would’ve stumped me if I were in the officer’s position.

A public place for the purposes of drinking laws is defined as “any place to which the public have access, whether on payment or otherwise” under the Licensing Act 1872 and updates. It applies here.

If you want to find out why the police took your names and what information they stored, you can submit a Subject Access Request.

Generally you want to avoid admitting to crimes or wrongdoing to the police
