Normally if a house isnÔÇÖt sold after a death, while estates are worked out, the house can be rented out at normal market conditions, and the rates and expenses of said house (not living expenses a tenant would be responsible, but landlord expenses) would be paid out of the rent, and the ÔÇÿprofitÔÇÖ would be put into the estate that gets divvied up.
Your brother can stay there, as a tenant, at an agreed rent. See if that floats his cork.
Fair market rent is required to be paid to the estate until probate goes through. At which point the estate is divided accordingly.

Can the courts make you sell the house and he gets nothing given this?
Also if the house is not sold within 2 years of the death of the father it will be subject to cgt
If you don’t think the legal advice sounds right the place to go is another lawyer. I wouldn’t believe anyone here over an actual lawyer. I would be asking more questions about what rights you have to recoup losses and things like rent. It might also be worthwhile getting valuations on the property done as well as tracking rent prices for similar properties in the area so you can ascertain the loss you have had if you haven’t gotten any legal advice on that sort of thing.

Went through something rather similar and was advised about 12 months through to removal. Obviously needs a bunch of evidence that they are failing in their duties as executor. I read a bunch of cases and it was amazing how most of them had gone 5 years with nothing been done THEN they went to court.
Seriously, people can be such obstinate a holes when it comes to this stuff and just camp out in the main asset. We eventually got them out – but it has since meant all sorts of capital gains tax problems due to the 2 year rule etc.
Maybe the question is, what are you going to do if he doesnÔÇÖt move out on a year?
Maybe moving towards gaining evidence that they are not acting as an executor but in their own interests, getting seperate legal advice from the estate lawyer and starting the process.
