Recently, a mug fell from on top of the fridge onto the stove and shattered the glass making the stop top portion unusable. Renters covered replacement of the stove since it was my personal property and I didnÔÇÖt have to eat the cost of a $800 new stove.

    No way one cup of coffee did that. If I spilled that in my house it wouldnÔÇÖt make it past sub floor. If it did, it woudont soak through the drywall(ceiling) to that extent either.

    Also sometimes have to repaint entire ceiling but often times you donÔÇÖt.

The first question is whether there is some sort of building code or general standard, which says, in effect, that floors should be able to withstand a single drink, spilling without penetrating to lower floors. If thatÔÇÖs the case, then the failure of the apartment to meet normal standards of construction is the most important cause. The landlord had a duty to tell you that if you spill a single drink in that kitchen, it will cause significant damage to the apartment below. If the landlord did not give you such a warning, or if the landlord did not know, then the landlord has the greater responsibility.

    Your guest spilled the coffee, not you. ItÔÇÖs a negligent act, or perhaps a trespass. While people are sometimes responsible for the negligent actions of their guests, thatÔÇÖs not always the case.

    I’d call the number on the bottom. This is an odd case because you have only caused minor cosmetic damage.

    I’d also say $1000 for a coffee stain is ridiculous. It needs a light clean, spray of stain blocker and to feather in the paint.

    The $1000 is probably a minimum the painters charge. The job maybe too small. Perhaps a handyman can do the job cheaper. And yes you can match the color so you donÔÇÖt see the repair.

    You have a contract with the landlord, probably a deposit that the landlord will take money out of. If you damage your own apartment, the landlord keeps money out of the deposit.

    With the downstairs neighbor, you don’t have a contract. They aren’t holding your deposit. They would have to sue you. They are unlikely to do all that paperwork to go and make the argument that you owe $1,000. That said try and see if the neighbors will let you have a painter in to look at it and quote you, or you contact their painters and ask about this, and see whether a painter will quote just touching up that spot. Or get a ballpark price from Angie’s List to touch up a spot, and see about showing that to the neighbor.
