    I’m in CA and my ex owes almost 40K in arrears. The courts, including child support services, move sooooo slow.

    Have you thought about filing contempt charges? I heard it’s hard to “win” but my attorney told me that there are 3 different punishments for contempt charges – 1. Community Service. 2. Up to $1000 fine. 3. 5 days in jail. Every month she doesn’t pay is 1 contempt charge… so if she hasn’t paid in 5 yrs you can bring 60 contempt charges against her. You might win, but even if you don’t, maybe it will scare her enough to get her $hit together? I know it would scare me. Jail time is probably the least likely since CA is so lenient, even with violent offenders.

    The reason my attorney said it’s hard to win is because you have to be able to prove they have the ability to pay and they are actively choosing not to. You would probably have to gather her work history, education level, and look on Indeed for jobs that fit both to prove she could get a job. Probably her location too… job in SF, LA pay a lot more and are more plentiful than the more rural parts of CA.

    My child support worker said they will do everything they can to collect but my ex is also licensed through the state so they can suspend his nursing license. Although it’s been over a year since I’ve seen a payment and his license is still active.

    But no, they will probably never, other than contempt charges, bring any sort of criminal charges against your ex for failure to pay.

    I have no advice unfortunately. But I wish you luck! I have a similar situation in CT. Deadbeat are the worst. It seems if youÔÇÖre the first parent to neglect your children then its ok in the courts eyes.

Also, you can try doing a Google search for case law as it relates to non-payment of child support for the state that originated the support order.     Not alone in this unfortunately. My sonÔÇÖs birth mom (who I have full rights to) owes over $20k in back support. She makes every excuse in the book as to why she canÔÇÖt pay. Claims to be in contact with the support office. They havenÔÇÖt heard from her in 3 years.

    14k in arrears from mine for the last 2 years,, has never paid a dime. CA DCSS attached to her bank accounts and then she went to court to complain they dropped it from the 9k they took to 1800, 2 months later and still not a dime (its sitting in “review” whatever that means). I still pay spousal support every month, can’t withold it either. They are supposed to attach to her tax returns but I doubt that will happen. I’m just at the point where I know nothing will come of this and she will simply refuse to ever pay me, while I have to continue to drop 2800 a month to pay her to do nothing. She refuses to work, but somehow can maintain a 3k apartment, a new lexus, new hair extensions, nails, botox all the stuff. I keep a ledger of all the “shared costs” we are supposed to cover (kids medical and such) that amounts up to 20k on her part , another chunk of money I’ll never see. The injustice of it is criminal in and of itself, and frankly we all know that if the genders were reversed, I’d probably be sitting in a jail cell. I had to drop about 100k on attorneys fees to even get custody of my kids after years of abuse on her part, therapist recommendations, minors counsel, police reports, DCSS custody investigations, tons of supporting evidence to prove her abuse and neglect of the kids when they lived with her. She changed attorneys 9 times in 18 months then blamed me for “vexatious litigation”. The only thing I can say is, my kids are safe and thats the best payout I could have gotten.
