AI Legalese Decoder: Simplifying Child Support Payments

I am pleased to share that I recently commenced the receipt of child support payments from my ex-partner, reaching a cumulative amount of $1,657. These payments are intended to support our child’s well-being and cover various expenses. To provide a clearer understanding of our payment schedule thus far, let me provide some details.

Initially, on the 31st of the previous month, I received my first child support payment, which amounted to $764. This was a promising development, and I anticipated the continuation of regular payments to contribute to our child’s upbringing. Surprisingly, a second payment of $764 was recently made by my ex-partner as well.

While I had expected the payments to be made on a monthly basis as per the online information, I had initially presumed that the money would be deducted every two weeks from each individual payment. Consequently, I assumed the combined sum would then be utilized to settle the child support dues on the 1st day of each month.

He gets paid bi-weekly, meaning that he will have 26 pay periods per year. The total child support obligation for the year is $1657 x 12 months = $19,884. Divide that into 26 pay periods and you get $19,884 / 26 = $764.76. He will carry a little bit of a “delinquency” at the end of the month because some months he will have two paydays, and some months he will have three paydays, but eventually after the 26th payday, he will have made the full payment for the year.

Do you get paid at work monthly? Very few employers pay their employees monthly. Your childrenÔÇÖs other parent, based on your information is paid bi-weekly. Take the court ordered amount, multiply by 12, divide by 26 and you will get the bi-weekly amount you are receiving.

Most garnishment orders sent to employers actually list weekly, biweekly and monthly amount to be garnished from and employees paycheck based on the garnisheeÔÇÖs order so there is little question on what is to be withheld from the employeeÔÇÖs check.

  • AudreyTwoToo

The orders are written by what is owed monthly, but no employer should be required to sit around with money on hold to send once a month. My mortgage is $XXXX per month, but I can pay it all at once or in multiple smaller payments if I choose. As long as the full amount gets paid, it doesnÔÇÖt matter in what increments.

  • Downtown_Tumbleweed

Sounds like your ex gets paid twice a month so two payments are pulled to equal the child support required each month. So you wonÔÇÖt get the full amount all at once, youÔÇÖll get it split payments

  • [deleted]

As long as you get it, is it a problem it comes in half and half?
The amount is for the month, if they are paid weekly, youÔÇÖll get it weekly, if they are paid every other week, thatÔÇÖs how you get it.

  • BriefProfessional182

Child support offices generally send payments as they’re made to the them. So if they’re pulling money twice a month, you’ll get it twice a month. If they pull it once a month or he’s on voluntary pay once a month, you’ll get it once a month. If he got paid weekly, you’d get paid weekly. Does that make sense? They (usually) don’t hold onto the money that comes into them, they process it all immediately.

Good luck. Florida sucks when it comes to child support. They canceled mine during covid for no reason and because I couldn’t pay the state got 7 months behind and then they tried to serve me for non payment lol
