    The letter from the attorney is just a generic one that they use all the time probably. I’m a bodily injury adjuster and I cannot tell you how many times I’ve read letters of representations or demands that state “serious injuries” yet it’s just neck or back sprain.

    Just send a copy to USAA like you said they asked you to. If suit was filed, they will get an attorney assigned to represent you and look into it further. You do not need to retain a separate attorney. I would not stress too much about it right now. This happens more often than you think.

    Some people literally live off of these type of claims. Someone probably told them two years later when they were talking about the accident that they could sue and make some money, or they were watching TV and saw an add from a some “accident lawyer”.

    There is literally 0 for you to worry about here. This is a quick cash grab and your insurance will probably settle with them somewhere around 20k and your premium will bump up a little.

    Relax. Send the letter to your insurance like they asked, they’ll likely sort it out by telling them to gtfo because they already settled the matter with the previous payout. Your insurance will organise an attorney if it’s needed.

    Like everyone said here, this is why you have insurance. Call them and they will ask you to send in the letter. They aren’t during you, they are sueing for your insurance money.

    Read your policy, but if USAA is everything it’s cracked up to be, your policy should include language that states they will defend you in a lawsuit. Is this an actual lawsuit or just some attorney’s BS? Definitely send USAA the letter and then follow-up with them.

    If USAA are already paid out a claim then they’ve likely already waived any rights to sue. Send your insurance company the letter they’ll deal with it. This is somebody probably just trying to take advantage of the system hoping you don’t know how insurance works.
