    He should only have to pay tax in Japan OR Canada, not both. If Canada is claiming he is a tax resident then he should be able to get a refund on taxes paid in Japan. If he feels he was not a tax resident of Canada, he will need to battle it out with the CRA. (They’re nothing if not tenacious and they will want their pound of flesh.)

    You should probably have a read through the Canada/Japan tax treaty and then consult with an accountant who specializes in international tax.

    Another potential issue is….was he working in Canada illegally? Because that could be a separate issue on its own.

    How did the CRA find out about your husband?

    If he has no employment income and no investments in Canada then you would simply tell the CRA that there is no income to report.

    You only have to fight if they come back as insist he report his world wide income. At that point you need to pay a professional to respond.
