    It would be illegal to fire to any employee who is covered by the NLRA for discussing **this** “confidential” information (salary, benefits, etc.) amongst and between each other.

    If an employee is in a position where they are not covered by the NLRA they could be fired for this and not have any recourse under the law.

    These positions not covered by the NLRA are (quoted from the NLRB website):

    * public-sector employees (employees of state, federal and local governments and their sub-divisions),
    * agricultural and domestic workers,
    * independent contractors,
    * workers employed by a parent or spouse,
    * employees of air and rail carriers covered by the Railway Labor Act,
    * and supervisors (although supervisors that have been discriminated against for refusing to violate the NLRA may be covered; the term “supervisor” is defined in the act).

Your employer will always pay someone the least amount that they have to, their job is to make money and you making less means they make more. Discuss that shit fuck them

    Policy and company instructions do not outrank the law and a complaint to the National Labor Relations Board would catch them out on that. The law says that you can share wage information with whomever you want at your own discretion. If they punish you for doing so then that is illegal.

    Companies often do stuff like this knowing that the policy doesn’t have any teeth because if you choose not to share it then it’s functionally the same as being prohibited from sharing it. Which is also why the NLRB tends to start snooping around when they hear about policies like that.

    Usually, when this happens it means that there’s a big disparity in pay between various employees inside the same positions, and possibly for discriminatory reasons. If those who were being underpaid knew they were being underpaid they would either demand (and get) what they should be earning or they’ll quit for another company willing to pay them on the same scale as everyone else. Employees quitting is expensive, and trained workers jumping to a competitor is damaging to the business.

    In short, management is trying to cheap out on employee pay and when it became clear that it’s too big to hide they’re trying to scare people into not looking.
