    You can try negotiating, but only being there 1 year won’t get you much severance. More seniority gives you better leverage to get a higher severance package. What she’s currently being offered is higher than the minimum she’s entitled too – I would say it’s a fair offer. You can try having an employment lawyer or paralegal look over the offer, but fighting for more will cost you legal fees.

    Try to negotiate the payout after her maternity leave is over (not sure if it’s possible). If she receives her severance during her mat leave they will allocate it against her EI and she will end up with a large overpayment at the end.

    If it wasn’t mass layoffs it could be a human rights / discrimination on the basis of sex case.

    Best to go to an employment lawyer who offers contingency ie. they keep 30% of any IMPROVEMENT they could negotiate above and beyond what you’ve already been offered.

    There is no downside here and depending on your wife’s original contract there could be additional upside.

Typically the package should cover until it would be reasonable for you to find an equivalent job in the field related to your experience and education. If that would typically be 6 weeks then sure. If that would be 6 months, then she may be entitled to a whole lot more legally. If you think that may be the case, good idea to have an employment lawyer who is familiar with how that all works review it.

    Not a lawyer but has she asked if it’s an option to finish off her maternity leave and then if her job is still not around at that time, then they pay her out severance?

    I understand that her employer is allowed to lay her off as long as it’s non-discriminatory, but considering she still has a lot of time left on her maternity leave, I hope they can explain how they can be sure that her role is no longer required, or the company won’t be in a better financial position, 7 months from now.

    I’m about to go off on maternity leave and know that if this happened to me, those would be the questions I’d ask. Not just from a payout perspective, but also because I’d want to avoid a large resume gap and would want to finish my 1-year maternity leave before worrying about finding new employment.
