    If you have gathered all the information you can, then the next step is to find an attorney to talk to- whether or not there was a breach of the duty to care by the police is fact dependent, and they’ll need to dig into the facts to see if you have a legitimate cause of action here.

    Call a civil rights lawyer in Rhode Island who has experience and a record of success in suing the police, jailers, and prisons. Note that many law firms don’t reply to emails or “contact us” submissions from their websites due to high level of spam they receive.

    Theres some misinformation on EMS here. Some practices will vary by state and county, I highly suggest you get copies of any report you can get your hands on. Start with the ambulance company and/or fire department who responded. You may need to provide proof you are legally entitled to receive a copy of the report.

    EMS will not refuse care to someone asking for it. Thats illegal. Im not familiar with the east coast laws, I work on the west coast, but no one should deny care even for someone complaining of toe pain. Full stop.

    Having said that, in some areas yes the police can override EMS. Your mom may also have signed an ÔÇ£against medical adviceÔÇØ form. If EMS advised she go, she refuses for whatever reason (maybe she wanted to get the stuff with PD over with), she may have signed that form if she was fully alert at the time. This doesnt mean she couldnt change her mind even while in custody, people do all the time. certainly someone should have checked on her and called for help when she started to decline.

    I am so so sorry that this happened. As an attorney, I think you should absolutely contact a lawyer to discuss your possible legal claims. Although she was a CT resident, I have a hard time imagining how the courts there (much less in FL) would have any jurisdiction over any possible claims. So my advice would be to contact an attorney based in Rhode Island where everything happened. There should be a bar organization that you can find for referrals if you donÔÇÖt know any lawyers there already. But youÔÇÖre right to want to get moving asap. Any attorney you speak with will want to do preliminary info gathering and due diligence, so you want to make sure you have enough time for them to do that and draft/file your complaint before the limitations period runs out.     I don’t know how it might work in RI, but here police wouldn’t override EMS for a misdemeanor warrant. The jail also would not take someone who had been receiving any kind of medical attention without being cleared by a doctor first. You need to find out if that happened before she was accepted at jail intake.

    The police can’t “override medical”. If the EMTs felt she required transport they would’ve taken her to the hospital in custody. Happens all the time.

    If the EMTs cleared her from the scene then there’s no issue with the police taking her in custody to jail on the warrant. Further, if they cleared her and her complaints did not change there’s no requirement for the police to continue seeking different medical attention.

    I say this not to say you don’t have a case but to say that a suit may be a tough thing to succeed at. Your first step would be to get the EMT records to see how they handled it. If they cleared her medically then your question becomes whether they properly handled the situation based upon what was presented to them.

Essentially, you have to prove that an earlier medical intervention would have resulted in a better medical outcome. That one is not easy with medical conditions like this one. The outcome could easily have been the same.

    The other issue is that state law sometimes limits recovery of damages. Again, this one is very state specific. In many states, a self-supporting adult child might not have ÔÇ£legal standingÔÇØ for damages. A surviving spouse would have such standing, but that does not seem to be the case here. If there is no money in it for anyone, including the attorney, then it would be pointless to file a lawsuit.

    Because this one happened in Rhode Island, you likely will need an attorney in that state.
