    What country/state are you in? Because that’s not how possession normally works. While a pic of it on the back of the truck would have been nice, at the end of the day she arranged the pickup, doesn’t matter who loaded it or not. Transfer of control/possession occurred when it left your property on their truck.

    Let her take you to small claims court, but she’ll need to take the driver too.

I mean, if our delivery person just loaded the frame of the couch, wouldn’t they be intelligent enough to inquire about the cushions? Seems a little weird to sell just the frame of the couch.

    Either way, you’re responsible for receiving payment and providing the couch. They’re responsible for verifying that all parts are there and loading it, securing it, delivering it. She’s responsible for hiring a competent delivery person or being on site at the time of delivery pick up to verify the merchandise.

    in the business world, most companies ship FOB destination. That means the receiver is responsible for the freight the moment it’s loaded on the truck. The truck driver acknowledges what you have provided on the Bill of Lading which includes a description of the goods being transported and you both agree it’s complete. That reduces the liability of the shipper.

    Since this was a private sale and you have done your due diligence to make them whole, I’m pretty sure you can tell them to kick rocks.
