Received a Fine in Split, Croatia for Drinking in the Street

Hello,

I hope this message finds you well. I am writing to seek advice regarding a recent incident that occurred in Split, Croatia, where I have received a fine of Ôé¼300 (with the option to reduce it to Ôé¼150 if paid within three days) for “drinking in the street.” As a UK citizen, I am unsure about my rights and options in this situation. In order to maintain anonymity, I have created a new account to reach out for help.

The incident took place at a bar that was part of a palace wall. It is worth noting that the bar had no tables or chairs, and we were informed by the staff that we had to consume our drinks in cups due to the presence of police officers in the area. We were assured that as long as we stayed within the rectangular boundary in front of the bar, we would not be violating any regulations.

However, a group of individuals wearing white shirts approached our group, accompanied by a police officer, and requested identification from three of us. They did not provide a reason for this request, so we assumed it was a routine check of our ages. To our surprise, each of us was handed a Ôé¼300 fine for “drinking in the streets.”

Furthermore, these individuals threatened to pursue us in our home country to collect the money. This is particularly concerning to me because I did not consume any alcoholic beverages, and we remained within the designated area as instructed by the bar. When we questioned the police officer about this, we were simply told to look up the law ourselves and reminded that we were not in England, implying that different rules apply. Additionally, we inquired about the absence of signs warning against drinking in the area, to which we were informed that putting up such signs was prohibited due to the area being a palace and a UNESCO protected site. Moreover, we raised concerns about the bar’s role in providing misleading information, but were informed that the bar is allowed to sell drinks and it is our responsibility to consume them in the appropriate location. It is worth noting that the fines were issued after everyone had purchased a drink, which raises questions about potential entrapment.

In light of this situation, I have a few questions:

1. Can the Croatian authorities pursue the fine when I return to England on Wednesday?
2. Do I have grounds to dispute the fine on the basis of entrapment?
3. Could the bar be held liable for misleading us about the designated drinking area?
4. Is it legal for the authorities to issue fines for non-alcoholic drinks?

While I plan to seek advice from the British consulate, their offices are closed until Monday, and I would greatly appreciate any advice or insights you could provide in the meantime.

A Croat here, but not from Split. Split has introduced a fine for **drinking alcohol** in the old town outside bars/restaurants/other places that serve alcohol. The fine is 300Ôé¼, or 150Ôé¼ if the fines is paid in 3 days.

    >Can I dispute this as entrapment?

You might be able if you have a reciept from the bar where you bought a non-alcoholic drink.

    >Is the bar liable for giving us misinformation?

There is a saying in Croatia. “Would you jump in a water well if someone said to you, to do it?”. You might add that information, but I doubt It’ll help you.

    >Do they have a right to fine us when we were not drinking alcoholic drinks?

Definitely not. The fine is specifically for drinking **alcoholic** drinks.

    >I intend to go to the British consulate to get some advice but will not be open until Monday so looking for advice in the meantime.

    Definitely consult with them.

You should also probably contact on call ” Komunalno redarstvo Split” which issued the fine

Also, might write this on r/croatia, r/hrvatska, r/AskCroatia. As you could maybe there, find someone from Split who will have more info.

If you ever intend to enter the EU/Schengen zone again: pay the fine. It’s really not worth the hassle. Additionally, “disputing” it would need a lawyer that would certainly cost more than the Ôé¼150.
