Title: Advertisement Placement Fiasco: Seeking Legal Recourse to Remove Sign from Residential Property

Introduction:

Recently, our peaceful abode has become an inadvertent destination for unexpected guests, thanks to a rather perplexing advertising blunder. In search of a prime advertising spot for a local plumbing business, our front door has been mistaken as the entrance to the said establishment, resulting in unsolicited visits from bewildered individuals. The magnitude of this situation is truly astonishing, as the installation of a sizable 2m x 3m sign, strategically positioned above our front door, has only exacerbated the issue. Understandably, we are deeply concerned that this communication mishap will persist, subjecting us to continual disruptions. This leaves us pondering if any legal recourse exists to redress this unsettling situation.

The Incident:

To make matters worse, the sign installers entered our residential premises without the courtesy of knocking, erroneous in their belief that our flat was, in fact, the intended plumbing company. It is disheartening to recount how this act was executed without prior consent, rendering us completely uninformed of this unconventional advertising undertaking. The audacity of such actions is beyond belief, leaving us feeling disrespected and doubtful about the level of professionalism that transpired.

1. Trespass: The unauthorized entry into our flat by the sign installers is arguably an act of trespass, violating our right to privacy and peaceful enjoyment of our property.

2. Nuisance: The presence of the sign, positioned above our front door, may be considered a nuisance if it results in continuous disturbances, such as unwanted knocks and unexpected intrusions.

3. Infringement of Property Rights: It is essential to investigate whether the signage infringes upon our property rights, potentially encroaching on our ownership and diminishing the value of our home.

4. Contractual Obligations: If there was no prior agreement or consent regarding the installation of the sign, it is crucial to ascertain whether the plumbing firm has breached any contractual obligations, thus providing grounds for removal.

Check with your local council to see if they have/need planning permission to erect such a sign. I know some places limit the size of signs put up, even on the actual business premises themselves.

I think you might be severely overestimating the amount of walk-ins that a plumber gets. Generally people expect a plumber to come to them rather than to take their broken toilets and sinks down to the plumber’s address. Keeping your door locked should prevent any confused plumbing customers from wandering in; though this would probably be wise anyway if you live on a busy road.

You can speak to the local authority and they can look at whether there’s any sort of planning issues with this sign being up. You won’t be able to get it taken down simply based on the worry that it might make people think you’re a plumber.

  • Surkdidat

Was the door unlocked or did they have a key? Just change the lock, and put it back when you leave

  • PeggyNoNotThatOne

I agree that planning permission is probably the way to get it removed. Ring the planning department of your local council or at the very least have a look on the council’s website to see if planning approval was sought or granted. It can be a bit like walking through a maze but all the information should be on there.

  • aldwychagain

Just a technicality here but everyone above mentioning ‘planning permission’ actually mean ‘advertising consent’ which is an entirely different process.

  • Potential_Fishing359

Definitely go down the planning permission route as it is unlikely he got this before putting up the sign, most local authorities have rules in place for this. My uncle was offended by a business opposite his house putting up a big advertising sign in his eyeline and he reported it to the council who asked the business owner to apply for planning permission or take it down

  • lissongreen

Yeah. A sign like that would need advertisement consent rather than planning permission, but the process it pretty similar in that they have to apply for consent from the council and the application is dealt with by the passing department. The council can only refuse an advert on the grounds of amenity or safety, so if it looks bad they could refuse it.

  • Cannapatient86

He isnÔÇÖt required to ask your permission to install the sign at all they shouldnÔÇÖt have come into your property without notice ect

  • redknoxx

NAS – however he doesnÔÇÖt need your consent to place the sign, he does need your consent, rather must give you prior notice to allow workers into your home, and then walking in was unacceptable. Though they may have been given a key, even if they did so, the landlord should have advised you, given you the time frame and notice.

I understand your dislike of the sign, IÔÇÖd be mortified as I find it quite tacky, and it takes away from the aesthetics. As shallow and minimal as that may sound, sometimes the aesthetics and feel of the home/area has a lot to do with people renting that specific home. So I wouldnÔÇÖt be too happy either if itÔÇÖs an eye sore. But legally, heÔÇÖs able to do so, though he should have consulted you especially as he had workers enter your home.

Could you not ask him to remove it? I know itÔÇÖs unlikely and heÔÇÖs more certainly than not, going to keep it up, but perhaps if you speak with him he could move it elsewhere, at least give you notice moving forwards, or if youÔÇÖre truly scared add additional safety measures such as ring doorbells, cameras, alarms etc?

  • Jaekolt

Guessing the landlord doesnÔÇÖt own the entire building and rather just the individual flat. As such he ÔÇ£shouldÔÇØ have had to get permission granted from building management or the owner before doing it, which I find hard to believe being sanctioned without at least notice to all residents.

  • Affectionate-Emu1374

I donÔÇÖt think he has to have your permission as itÔÇÖs his house. IÔÇÖd lock your doors though, someone trying to get plumbing work done is the least of your worries

  • seriousrikk

Do you not lock your front door?

You wil have little or no recourse for getting the sign taken down, it’s not your building.

Tak to your landlord about people just walking in – it was a mistake of course – but also one that locking your door would prevent.
