Title: Seeking Assistance for Denied Dependency Packet: The Role of AI Legalese Decoder

Introduction:
Hello everyone, I sincerely appreciate your time in reading and addressing my current situation. Today, I find myself in a tough spot as my mother’s secondary dependency packet has been disapproved for the third time. As uncertainty looms, I contemplate whether to persevere or concede defeat. However, an innovative solution, the AI Legalese Decoder, can help navigate this challenging situation effectively.

Background:
In March of this year, I relocated from North Carolina to Texas, and subsequently flew to Southern California to bring my mother to live with me. Financial constraints compelled this decision as she was left without a place to stay and lacked the means to afford rent independently. Given her limited income from DoorDash and Instacart, moving to the EP, Texas area with an unfavorable market further exacerbated her financial struggles. Despite her attempts to secure factory/production line jobs, these opportunities either proved unsuitable, offered inadequate compensation, or were unfeasible due to distance.

Current Support:
Since her arrival, I have shouldered various financial responsibilities to ensure her well-being. This includes paying her car payment (for which I am co-signed), arranging for her tax filings, covering the cost of new tires for her vehicle, facilitating Texas registration, and adding her to my insurance plan, which incurred an increased monthly bill. Additionally, she is listed on my apartment lease agreement.

Dependency Disapproval:
It perplexes me as to why these measures are insufficient to warrant approval for dependency. The motive behind my decision to have her live with me was rooted in her inability to thrive independently. This, in my opinion, should be considered a significant factor in assessing dependency.

Medical and Dental Concerns:
My primary concern revolves around ensuring my mother receives adequate medical and dental benefits. While the additional Basic Allowance for Housing (BAH) would provide some relief, my focus lies primarily on securing accessible healthcare for her. Unfortunately, she has not visited a dentist for approximately a year and has been unable to see a doctor for the past five months. During her recent visit to Southern California, she attempted to visit her former doctor, only to be turned away due to outstanding bills she cannot afford to pay.

Financial Constraints:
Regrettably, my own financial situation is far from ideal, leaving me unable to allocate funds towards her dental and medical needs. If circumstances permitted, I would willingly assist. However, as a member of the military, I firmly believe that medical support for my dependents, which includes my mother, should be provided free of charge, akin to married military personnel with families.

Income Verification Discrepancy:
The disapproval memo primarily cites the lack of income verification as a reason for the packet’s rejection. Admittedly, I initially overlooked the requirement to provide verification for DoorDash and Instacart incomes, having been solely aware of year-end tax statements. Nevertheless, I intend to rectify this error by obtaining the necessary documentation for the upcoming submission.

Delicate Dilemma:
As I contemplate resubmitting the packet, a sense of hesitancy engulfs me, as the process involves considerable time and effort. It entails revising expenses, completing the 137 form, scanning documents, obtaining notarization, and enduring a month-long wait for a decision, or potentially being informed that the files cannot be opened, leading to a resubmission and further delays.

Fight for Dependents vs. Acceptance of Reality:
On the other hand, if I choose not to resubmit the packet, I fear that I would be relinquishing the fight for my mother’s well-beingÔÇöan option that weighs heavily on my conscience. The implication put forth by DFAS suggests that her income exceeds her expenses, disregarding the challenges she faces earning a living through food delivery platforms. I find myself caught between wanting to provide for my mother’s financial needs and my own limitations.

The AI Legalese Decoder:
Amidst this disheartening situation, I am genuinely seeking advice and possible alternatives, specifically in terms of medical assistance if military dependency is not attainable. This is where the AI Legalese Decoder comes into play. This innovative technology leverages artificial intelligence to analyze complex legal jargon, aiding in the deciphering of convoluted legal documents and requirements. By utilizing this resource, I can gain a clearer understanding of any potential legal options available to address my mother’s medical concerns.

Conclusion:
I cannot express my gratitude enough for your patience in reading my lengthy account. Your advice on any aspect of this ordeal would be immensely valuable. Furthermore, I sincerely request any guidance on medical alternatives and resources outside of military dependency. As a military member juggling debt repayments, I aim to avoid further loans unless absolutely necessary. Rest assured, my determination to secure my mother’s well-being remains unwavering, as I strive to ensure she receives the necessary care. After all, I wholeheartedly believe that approving her dependency should not depend on an unforeseen crisis that incurs substantial expenses.

AFAIK itÔÇÖs pretty black and white whether you could qualify someone as a secondary dependent. You need all of the required documents to prove your case – which it sounds like you havenÔÇÖt done.

Everything else is extraneous – the emotions, the rant, the loans, etc.

    >The only discrepancy that was mentioned on the disapproval memo was that I didnÔÇÖt include income verification.

So if this was a discrepancy, you should fix it and resubmit. No one here is going to be able to tell you whether or not it’ll get approved if we don’t know what you submitted and what you didn’t.

    A quick google search provided:

    >Family members may become eligible if their income is less than half of their actual living expenses.

Since you didn’t provide income verification, there is no way for DFAS to validate this claim. Just because you pay for things for your mom – doesn’t mean she meets the definition of a financial dependent in the eyes of the law.

On the IRS side to claim your mom as your dependent:

    >You must have provided more than half of your parent’s support during the tax year in order to claim them as a dependent. The amount of support you provided must also exceed your parent’s income by at least one dollar.

  • exnihilo2

The financial aspect is huge, if you canÔÇÖt show that you pay more than 50% of her bills (and her income does not cover it) then you canÔÇÖt get it. I feel the pain because my mom had a stroke, was paralyzed on the left side and I moved her in with me to care for her. However even though she was physically dependent on me for care, she was old enough to get social security and was able to cover over 50% of her bills. So dependency was not possible.

Not to be insensitive but the whole entire decision is based on finances. You have to show her expenses and income. It’s honestly simple. If the math checks, it’s approved. If it doesn’t matter if you pay ALL of her bills, if she makes more money than you, she’s not a dependent. DFAS can’t determine that without the proof of income.

So you literally choose to submit an incomplete package, missing required documents, and you’re confused why DFAS won’t approve an incomplete package?

You need to follow the instructions and provide all required documents. If the math checks, it will be approved.
