    Check the plat for your subdivision. Make sure there is an easement there, and what the details are. If this is an older neighborhood, there might not be an easement. They can pound sand then as they need to get one. Enforcing something that doesn’t exist is a taking and illegal.

    Check the FEMA mapping center for your property. Determine what the flood zone is (A, AE, etc.). If it is a type A reach out to your DNR as they can help determine the boundary of the floodplain.

    Go up the food chain. Reach out to the City Manager or council/Mayor. Bitch like there is no tomorrow as these people typically just want the problem to go away and will overrule lower employees. Can you appeal the decisions to a Board of Adjustment? Maybe apply for a variance because the situation is a huge financial hardship the City created.

    In my USA city, citizens can make a complaint to the City Attorney’s Office. This is the CAO for the office that approved your plans. They have a Risk Manager in the CAO. It is their job to review, investigate and refer to their attorneys, and pay out mistakes made by the city.

    Look into a LOMA to see if you can get the flood zone changed, shouldn’t be more than $1000.00. Did you expand the footprint of the garage you tore down? Can you change the dimensions of the new addition to get it out of the sewer easement?

    What city are you in? If itÔÇÖs on the coast, specifically Houston metro or Beaumont Port Arthur, do not fight the flood zone issue. Texas flood zone are horribly outdated. My friend bought a house in Houston in a neighborhood that didnÔÇÖt flood during Harvey. It was built in 2019 with a two foot foundation (house value is $1.1 million now). Houses in his neighborhood are being built with 5 to 8 feet elevation. Flood insurance only covers $200k for real property and $50k for personal property.
