The Problem: Abandoned Construction and Erosion Concerns

We are facing a tricky situation with our recently purchased property and the empty block next door. On the property line, there is a newly constructed retaining wall, with our property being on the higher side. However, the construction seems to have been abandoned, with only concrete foundations and steel H pillars in place. This has raised concerns for us, as the retaining wall appears to have been designed to raise and flatten the area for building, but it is incomplete and erosion is occurring at the end of the wall.

Legal Complications: Builder Conflict and Ownership Transfer

To make matters more difficult, the owners of the property claim that the builder is still responsible for the site, as the issue has been tied up in court for several months. Unfortunately, our attempts to contact the builder have been futile as he refuses to discuss the matter with us. In the meantime, the property owners have decided to put the block up for sale, leaving us uncertain about how to proceed.

Communication Challenges and Limited Options

We have been in discussions with the property owners, but they insist that the issue falls solely under the builder’s responsibility. It seems like they are delaying any action until the property is sold, which is a cause for concern. Our proposed solution to split the cost of fixing the retaining wall has been rejected by the owners, who remain convinced that it is solely the builder’s problem. Unfortunately, our means of contact with them are limited to first names, mobile numbers, and addresses, and they have ignored our requests for email details.

Finding a Path Forward: Legal Remedies and Potential Consequences

We are unsure about the best course of action to take in this situation. One possibility is to seek resolution through the Queensland Civil and Administrative Tribunal (QCAT). However, we are concerned that the process may take too long, potentially allowing the property to be sold before any resolution is reached. Another option is to consult a solicitor specializing in property law, although this would involve additional costs. Our main worry is being left with an unresolved issue if the property is sold and the new owner does not address the problem, potentially leading to further complications affecting our driveway and garage.

You probably have slim to Buckley’s on getting a payment from the current owner. They’ve had it up to the eyeballs if their builder has gone bust and possibly deep in debt. Besides the fact that it may indeed be the builders issue.

For $500 I’d probably bite the bullet and get it fixed before it gets worse.

Local councils have some power with this. Lodge a retaining wall issue with them as a starting point. Its free
