**False Accusation and Harassment Incident**

Recently, I had a distressing encounter with two police officers who came to my apartment after receiving a 911 call alleging that I was engaging in lewd behavior on my balcony. Despite being in my apartment the entire day, the police insisted I fit the description given by the anonymous caller. I was left feeling vulnerable and violated, especially considering the lack of evidence to support the claim.

**Suspicious Neighbor Behavior**

I strongly suspect that the call may have come from my downstairs neighbor, who has a history of animosity towards me. His continuous loud music, which I have reported to the building manager and the police, has resulted in confrontations and even harassment directed at me. This ongoing conflict has created an environment of fear and unease in my own home.

**Seeking Legal and Housing Assistance**

Given the circumstances, I am considering breaking my lease and finding a new living situation where I can feel safe. I believe that my landlord has an obligation to address these ongoing disturbances and create a peaceful living environment for all tenants. I have tried to address the issue with the building manager, but I have not received a satisfactory resolution. I am also unsure of the extent to which I can pursue legal action against the false accusation made against me.

**AI Legalese Decoder Assistance**

In this situation, the AI Legalese Decoder could be incredibly helpful in navigating potential legal options and understanding my rights as a tenant. It could assist in deciphering any lease agreements, tenant protection laws, and potential courses of action against the false accusation and ongoing harassment.

**Seeking Advice and Support**

I am open to any advice and guidance from others who may have experienced similar situations or have knowledge of tenant rights and legal recourse. It is vital for me to ensure my safety and well-being in this challenging situation.

Any input and support would be greatly appreciated.

I think it would be worth asking your building manager if he sent a notice to them, as you have reason to believe he has retaliated against you by using the police to harass you. This is information the manager should have, and may assist in building a case to have him evicted.

You shouldn’t have to, but maybe invest in a surveillance cam in your house. The you’ll have proof alibi and possibly record your neighbor being a nuisance…

NAL but if he did call the police on you he can be charged for public mischief. ItÔÇÖs illegal to file a false police complaint.

  • limlwl

Keep evidence and continue to lodge police complaints against the neighbour and always get a police record number. Once it goes like 10 numbers and no actions, escalate it to someone higher or your local politician for some news highlights

  • Foxx90

Don’t talk to the police in a situation like that. You have no obligation to do so.

  • Girldad-80

My only comment is about the unsafe and scared comment. You are more harassed and annoyed, dont escalate it in your mind. Your neighbor is a dick and the things hes done are not to your face which means hes a cry baby and not a fighter. In my experience, he wont escalate to where your physical safety is an issue. BUT, moving might be the only way for peace of mind.sorry

NAL, but have delt with similar situations involving false accusations.

In short, the best action here is to do nothing – it’s already (or should be) documented if you need to reference it at some point in the future.

Anyone can call the police on someone else for any reason – that’s just the reality of it – you cannot control someone else’s behavior. The severity of the accusations will determine Police action, as well as your recourse, and IMO, the best thing to come out of this is that the police left and their report would indicate something like they spoke with you and found no reason to pursue.

As others have said, you do not have an obligation to speak to the police, but take that with a grain of salt – it is very situational-based – I think you did the right thing.

I understand it is uncomfortable, that will pass. If it really was a neighbor, then this is just dig, nothing more. Keep track of things like the mail with, “fuck you” on it, save any text messages or the like, and if possible (as others have said) put up a doorbell camera and/or outdoor cameras. Additionally, corresponding with the building Manager in a respectful way may yield results, but I do not have experience with this.

Shake it off friend, and good luck with the job interview.

Police will have the number of the person who called; let them know you believe it was your neighbour who made the call/false allegations. They wonÔÇÖt be able to confirm your suspicions either way, but at lease if it happens again it will be on the file.

  • JustanOldphart

You should go to the police not to defend yourself in this issue but to start a harassment complaint against your neighbour or whoever made the call. Make sure to tell them about feeling unsafe and scared.

(Not a legal professional or anything) I find it odd that this ”bystander” didn’t film/take a picture of the alleged scene with their cellphone as evidence. In this day and age this person didn’t have their cellphone on them?…It’s almost like they didn’t film it… because it didn’t happen. Is there any cameras around that may have filmed this scene or around this scene, if so I would ask the authorities if they could get that evidence to see if this ”bystander” was actually where they reported they were or to see if this alleged situation actually happened or not. If this situation happened to me I would refute it and ask the authorities as well IF they could obtain more info or investigate this bystander as this didn’t happen, can they for example obtain the cellphone data from the user to see where they were and if it matches their report. As others have said take precise notes of all that happened especially anything that backs your version vs this bystander’s, what you were doing as this alleged scene happened like if I was say browsing my computer I’d have shown them my browsing history with timestamps, if I talking with anyone as this happened, if someone or camera saw me doing anything else than supposedly being on the balcony, can’t be at 2 different places at the same time. Sorry this happened to you.

  • Purplebuzz

I believe I am being harassed. I did not do any of those things. Surely in the era of cell phones there would be a picture of video. I would be happy to assist in the pursuit of false reporting charges against the harasser. Is there anything else I can help with?

  • haleloui

Everything to do with what’s going on in your apartment is a landlord tenant issue, not a police fixable issue, so that part will go nowhere. At best noise complaints are by laws territory.

As someone already mentioned, this isn’t technically a false report (in any way that can be proven) so that avenue won’t amount to much either. You can contact your police department about harassment, however.

This is hinging on where you’re located too, I suppose. But you can always call the police non emergency number and ask for advice from an officer.

  • Ambitious-Way-6669

You can make a freedom of information request through the police department that includes the report and the original caller’s contact information, even if it’s just a phone number

It’s a long game that may take 30 to 60 days but gives pretty incontrovertible proof that someone tried to harass you, which supports peace bonds or restraining orders going forward.
