NAL. It sounds like your friend has been charged with assault of the ESM hence the advising of a court date. The paper work your friend received is mostly likely a notice to attend court to answer a criminal charge. The police would not contact your friend if it was a civil matter I.e the ESM personally suing your friend. This wouldnÔÇÖt make sense anyway as it sounds like a workplace injury and they would have more success suing their employer than your friend.

There is no difference between a solicitor and a lawyer.

I am not over familiar with the Justice system in Victoria, however I imagine there are provisions for dealing with this type of scenario under Mental Health legislation.

See a criminal lawyer or attend a community legal centre for advice.

Is this person being sued, or facing criminal charges?

Solicitor and lawyer are one in the same barrister and solicitor are not.

I’m not a lawyer but if it were me, I would contact legal aid. Your friend would have been given a summons for court with a charge sheet if police have notified her of court date – she can look it up on efas search function to get the case number and contact police (who is listed as the informant) and ask for a copy if she doesn’t have it. This should have a table at the front including any sort of inclusions (ie. Statements or evidence). Did your friend go to an ED and then admitted to an inpatient/short stay mental health unit? It would be wise to try get discharge summary if so.

Legal aid will either help her ahead of time or advise her that the duty lawyer on the day will be able to speak with her in any instance it’s important she gets there 30min before whatever time it says and when she checks in at the register advises she is requesting duty lawyer services and they can further explain the brief.

I’m sorry your friend has to go thru this after that sort of incident it would be rather re-traumatising I would think and that sucks.
