Well, it sounds like they know they don’t have cause to fire you, which is why they’re paying you 1 month per year you’ve worked as severance. That’s about as good as you’ll get. It’s certainly possible that you might be able to fight them in court and get your job back…. But do you want that at this point? You’ll be working for a company that you know will let you go at any time, and clearly doesn’t value you that highly. They’ll be pissed you sued them, and if you do get a position back, it will be given begrudgingly.
Take your money and apply elsewhere. Not worth paying a lawyer; they won’t get you much more money, if any.
One month per year is honestly a very good severance package.

Likely that any additional $ will go to most of their fees. It sucks. But one month per year employed is fair offer for severance.
I recommend you speak with a lawyer to get clarity, but this actually happened to me and it was legal. It was a larger company and I was also paid for a 90 day period while I searched within the company, on top of my settlement, but in the end was let go.
They go around it with the good severance package. Happened to me also. I know it’s hard to find work, but if they replaced you like that, seems like a shitty place to be.
You got good severance and, if you decide to blow your severance on lawyer fees with the goal of forcing them to hire you back, you’ll end up in a job where they don’t want you and will find a reason to coach you out.
They may have wanted to get rid of you prior to the mat leave and instead decided to let you have your leave and then provide a fair severance package. It could have been much worse.
I’d take the money and run and enjoy the extra time with baby while searching for a new job.
One month per year is pretty good. A lawyer will probably cost like 5-6k just for them to take your case and send a threatening email if you go to court it will be more. But think about how much more time you’d have to get to make up for that 6k. With that being said yeah talk to an employment lawyer and see what they say and also feel free to go back to the company and ask for a few months months or an extension of your benefits and see what they say, these things are a negotiation.
Happened to me as well, I accepted the money and just moved on with my life. Honestly found a much better job, good riddance!

Your options depends on the ESA that apply. Provincially regulated companies in Ont must provide job secuirty to an employee on mat leave. What happened to you could be considered constructive dismissal. You should certainly have the severance package looked at by a lawyer to clarify your rights and position.
