    Nal but a student loan nerd. PP are 100% the legal responsibility of the parent..not the student. With that said if she decides to sue you I suppose there could be a judge that decided you owed her the money because you benefited from it. I’ve been doing compliance and advocacy work in student loans for over 25 years and I e never seen that happen.

    She can’t do anything she’s threatening to do. That’s just not how any of this works.

    My advice: keep a very good record of every time she tries to communicate with you. Do not answer her calls; log them and save the voicemails. Ignore the emails but keep them in a folder. Keep any letters. Do NOT contact her.

    It will be harder for her to argue to a judge that you’re mentally ill if you don’t talk to her.

    I know this is emotionally difficult; please understand how abusive she’s being. She’s threatening to destroy you (leave you broke or have you forcibly put in a hospital) if you don’t cave into her demands. That’s deeply disturbing. You may find that your mental health issues will be alleviated when you get more distance from her. Not a psychologist, just walked this path.

    Therapist here and I actually have something to add to this sub! Your mom can’t force you to stay in a hospital based off of whatever claims she might conjure up. As someone else said, the worst she can do is call the police and have them do a wellness check but so long as you don’t look like (or say) you’re about to harm yourself the police won’t do anything. Hospitals don’t want you staying there unless you explicitly tell them there’s a chance you’ll hurt yourself.

    IAAL, but not your lawyer. As others have already said, Parent PLUS loans are applied for by, and the sole responsibility of, the parents. That’s literally what they’re designed for, to allow parents to apply for loans for their kids to use for college, rather than the kid applying for student loans with parents as co-signers. There’s nothing legal she could do to you. She could try, but it wouldn’t go anywhere, and I can’t imagine a situation in which an actual attorney would take her case.

    Anyway, best advice I can give if someone threatens you with legal action is to just ignore it until you get legal papers through certified mail.

    Edit: Apply for an income based repayment plan.

    (And, morally, you *aren’t* obligated to pay her back on those PLUS loans; if she expected you to pay for your education, she should have co-signed on a loan in *your* name. The “P” in PLUS stands for “Parental”.)

    During this period the child support payments were intended to support your education. If she spent the money on something else and signed a Parent PLUS loan for your tuition and related expenses that was her decision.
