Title: Unlawful Relocation of an Elderly Family Member: Seeking Legal Advice in England

Introduction:
In England, a concerning situation has arisen where a family member has unilaterally taken an unwell elderly family member to live with them without obtaining consent from the rest of the family. This not only raises safety concerns, as the living space is not suitable for an elderly person due to its location on an upper floor, but also entails the apparent removal of the elderly person’s previous tenancy. Additionally, there are suspicions that the family member harbors ulterior motives and now aims to gain control over the elderly person’s bank accounts. This article explores the legal points surrounding this scenario and highlights the potential assistance offered by the AI Legalese Decoder.

1. Legal Concerns:
The actions taken by the family member in question raise several legal issues that should be addressed. Some of the key areas of concern include:

a) Invasion of Privacy: The decision to relocate the elderly family member without consent may constitute an invasion of privacy. By unilaterally taking this step, the family member has disregarded the elderly person’s wishes and autonomy, potentially leading to emotional distress and legal repercussions.

b) Breach of Duty of Care: The family member’s decision to place the elderly person in an unsafe living environment, such as a residence located on an upper floor, may constitute a breach of their duty of care. This breach could be seen as a failure to provide a safe and suitable accommodation, which could result in physical harm or exacerbation of the elderly person’s health condition.

c) Tenancy Rights: The removal of the elderly person’s previous tenancy raises questions about the legality of terminating a tenancy without proper notice or consent. Depending on the nature of the tenancy agreement, the family member’s actions may constitute a breach of tenancy rights and may expose them to potential legal claims.

As long as the relative is in agreement and they are able to make their own decisions then itÔÇÖs fine

You mention below in one of the comments that it is “a child” that took the elderly family member.

You state in the original post the family member is not on “the most ground floor” but then you say below it is a garage on the second floor. I am not convinced you are telling the truth. I have never heard of a garage that is not on the ground floor.

You seem to be most concerned about money. Yet their own child is looking after them, and you think that is for “ulterior motives”? And exactly why is that bad? Children do (and should) expect to inherit the majority of an estate from their parents, even though the will may state something else.

It also does not sound like you are a sibling to this person. On the contrary, you sound like you’re from wider family and wanting to money-grab.

With that out of the way, you didn’t mention dementia or illness in your original post, and you are casting aspersions. If it is truly an unsafe environment and the person is not being cared for, or the elderly person is being held there against their will or is unable to understand anything, contact social services to visit.
