    Although you did commit the offence of possession of controlled drug, in my view you would have been able to avail yourself of the defence in s5(4) Misuse of Drugs Act 1971: basically, that you took possession of it to hand it in to the police.

    You should get in touch with the police and ask to make a complaint and have it rescinded and to receive an apology. I suspect the officer wasnÔÇÖt aware of this provision at the time. You have not been given a caution, but a community resolution or a cannabis warning – but either way, you should not have it on your record at all.

    Not sure what you can do now, but for future reference NEVER accept a caution if you believe you are innocent, this goes for anything not just drugs.

    Acceptance of a caution is acceptance of guilt, I believe it can be expunged, but it’s a bit of an uphill battle as you have essentially admitted the crime, and they have a form you’ve signed to prove it.

    Neither of them require an interview to administer, but accepting them *does* form an admission of guilt.

    You have a defence against the possession of cannabis if you intended on giving it to the police to dispose of.

    Assuming you have a copy of the paperwork, I would suggest that either you or a legal representative (if you have legal cover through your workplace) phone (or use an online contact method such as webchat or email) the force in question to make a complaint, proving any reference/officer details on the paperwork.

    Did you actually receive a caution (you were interviewed under caution with legal advice, admitted the offence without any ambivalence and advanced no defence, then asked if you would accept a caution) or some other disposal?

    Irrespective of protocol/procedure, if I somehow managed to get in legal trouble whilst doing my job in good faith, I would move heaven and earth, and contact anyone and everyone, until it was sorted with no detriment to me or staff around me.

    Which is to say, donÔÇÖt ÔÇÿacceptÔÇÖ anything. Challenge, complain, follow up, take legal advice, escalate etc. whatever is most appropriate.

    Make sure you have a contemporaneous, dated and timed written record.

    Involve your boss, your bosses boss. Internal incident procedures. Whatever you have at your disposal.

    [NAL] Complain to the chief constable and to the PCC (if you have one) for the force. Copy your MP, and everyone else involved in the commissioning and operation of the Safe Haven Project service. That you’ve received a caution for helping the police out and doing the right thing is an outrage and an affront to policing by consent.

    Frankly I would be seeking an apology from the chief constable, confirmation that the officer in question has been reprimanded, and the removal of the caution from any police records.

    I donÔÇÖt understand a few things about this. I am a nurse at a community drugs team and on a couple of occasions have handed in drugs found on the premises.
    On no occasion have I had any issue with this – IÔÇÖve taken it to reception, explained what I have found, told them that I have no idea who owned it and it has been taken for distraction with a ÔÇ£thank youÔÇØ. Job done.
    The other part I donÔÇÖt understand is why on earth you would accept a street caution for possession – you have admitted that you were unlawfully in possession when you had a reasonable excuse for being in possession.
    Your NHS trust will have a legal department – you need to speak to them and complete a datix ASAP

    How did they manage to give you a caution without you accepting that you have committed an offence?

    Part of the process would be to ask why you had it in you. If it’s anything other than its yours for personal use, I don’t see how they could issue you a caution.
