    – other people had access to the draw

    – that although your responsible for your job she is accountable for security

    – and you can’t be held responsible for a draw that you weren’t personally in front of for the entirety of your shift.

    Tell her if she insist on breaking the law and deducting your wages, then you’ll insist on locking the register or walking around with the draw when your duties require you to move away from the front desk.

    At this point your boss should realise just how bad their security is and not attempt to bill you.

    But at the end of the day who’s to say she didn’t steal the money and is just blaming you, double dipping.

    As others have advised, report them and move on. Low paying jobs a dime a dozen.

    The owner would need written consent from you, also could not bring ypu lower than minimum wage. If they do deduct it and they don’t have written consent and/or it brings you below minimum wage, file a wage claim with your states labor department.

    Accountant here. This is a basic failure of internal controls, and it’s not going to stop happening if they don’t change the way the drawers are handled (closing, counting and reopening) between cashiers.

    The practical answer is you should be looking for a new job.

    You can’t be forced to pay back shortages if it brings you under the minimum federal (or state, if state minimum is higher) wage. They can’t really hold you accountable in a situation where even one other person has access to the same till. If you aren’t allowed to start a FRESH drawer (count it out before you start your register, with a fresh paper trail for YOUR shift only), then they can’t determine if you or someone else is causing the shortage. Every job I’ve ever had as a cashier, I’ve had to count each and every drawer at start and end of my shift. I had a register receipt with the total shift balance. I either started with a freshly drawn drawer (one that management counted out, then I counted out), or started with the drawer that the previous shift counted and dropped their excess from. Then I had to recount the drawer, and we had to match. If it didn’t match, we had to recount it, both of us. This was with every drawer, every time. And I never let anyone touch my drawer. Or if someone did, I was supposed to be right next to them.

    This actually saved a manager once. We knew that a manager had lost about $100 once, and she couldn’t find it. Later that week, I got a drawer from management, one that they had in the safe. I started to count it, but realized almost immediately that there was too much money (too many $10s), and stopped counting. Turns out that the drawer had the missing $100. She didn’t try recounting the drawers (neither did anyone else) that were in the safe, and didn’t catch that she miscounted it. She probably still got written up, but I ended up probably saving her job by realizing the drawer was over. Irony was, I hated that particular manager too.

    OP I just moved back to NE and theyÔÇÖre begging for help everywhere, just go find a new job. IÔÇÖve worked at ÔÇ£small family ownedÔÇØ restaurants and the owners will cut any corners on costs. And IÔÇÖm pretty sure in NE they canÔÇÖt do that unless youÔÇÖve broken something beyond ÔÇ£normal wear and tearÔÇØ.     Amigos is a great restaurant with shit upper management. They legally can’t deduct your wages, and if they do, contact the NE Department of Labor. Also, you should go work for Runza. Better food, and while it’s been a while since I’ve been there, they usually have decent managers.
