Files breaking off in the tooth during root canals is a known complication and I suspect you would have been advised of this prior to agreeing to the root canal so I am not sure how much comeback you have legally unless you can prove beyond doubt that the dentist was negligent (which is difficult). Worth looking into though to see what your options are.

Consent form would (normally) include all the eventualities that can happen – files separating is one of them.
These things happen but they don’t immediately mean negligence. Shit happens to everyone.
I remember the first time it happened to the dentist I worked with. He was devastated.
Nobody does it on purpose but yeah – shit happens. Any treatment you have at the dentist can go wrong.
Simple filling? Maybe the pulp gets irritated and dies – now you need a root canal treatment.
Need deep cleaning because your teeth are loose and root scaling is the only thing that can help you save them? Well now that the gunk is cleaned off, nothing is holding the tooth and you can end up losing it anyway.
However, lodging a claim wouldn’t bleed the NHS dry – that’s why as dental care professionals we have indemnity in place. Your dentists insurance would pay for. (there goes their premium next year! 😂)
Before you start with a third party, you can lodge a complaint with the practice and see where it leads. They will ask you what is the outcome you’re after. If you say you’re after compensation, you may well get it.
If they have informed you of what happened(when it did) and explained the risks prior to the treatment (this will be in their notes) they won’t necessarily be at fault.
If I were you, I’d request my notes and exrays to start with and take it from there.
I’m not a dentist or lawyer but have had a few dental procedures…
In the two root canals I’ve had they have warned that there are risks with the procedure. The difficulty with a negligence claim will be that a root canaled tooth is already compromised and at risk and it’s not uncommon for files to break in the procedure. The root canals are small and can curve, and the dentist often only has an x ray to work from. Which is why the procedure comes with some risk of failure.
Also, £4k!?
As an NHS dentist I’d ask you to kindly consider contacting the practice of the dentist who did the original root canal directly rather than going through a 3rd party. It is a known complication of a root canal treatment and unfortunately can (and will) happen to any dentist. I completely appreciate your point that you are now out of pocket but also consider the perspective that without any intervention from the original dentist the tooth would have been lost anyway. Dentistry is an incredibly stressful job and the third party claims can be pretty awful with how they come after dentists. I know a few dentists that have quit altogether because the whole process is so stressful and they lost all confidence in their ability to do their job without risk of getting another complaint. I can’t speak for other dentists obviously but if a patient was unsatisfied with my treatment I would hope they would write to me first and give me a chance to rectify it, rather than engaging those companies that kinda seem to come in like a sledgehammer.
Make the decision that suits you best, but please consider writing to the dentist first 👍
Files breaking of during root canals is a common risk I’m afraid meaning it could have happened to any dentist which makes the claim for negligence very difficult if not impossible.
For these claims to succeed whether medical or dental the standard of care needs to be well below average and this doesnt seem to be the case here
Your best option is to see if the NHS dentist would be willing to refund you the NHS fees

Hi, work at an NHS dentist here. Any treatment plan states that you have been informed of the risks of procedures in the block of text at the top. You likely won’t be able to get anything. This is not your fault and is part of the system. It’s annoying they will use this against you.
A better avenue would be to report it to the CQC – the body that governs dental practices. They are the ones who have the final say in a practice being open. Also as a nurse is always in the room for treatment it’s 2 vs 1. The practice also can’t employ without an enhanced DBS check, so to be a dentist they have no criminal background, which is taken into account in most legal situations. Even a parking ticket would work against you.
This is my understanding of the system from working inside it. It’s not a qualified legal perspective but it’s what I can offer.
CQC has its own website, it’s the Care Quality Commission and the information needed to make a formal complaint would be on the practice website.
