    Ok so there is lots of emotional advice here. And IMO itÔÇÖs wrong. So hereÔÇÖs the deal from someone who has spent a lot of time working in this industry on how any court including NCAT is going to consider this matter. (Please note I am NAL, nor a licensed agent anymore – I retired from this industry a little over 2 years ago.)

    Your aunt, for better or worse, has an established residence there. Her mail (probably) goes there, and her identification, drivers license, voter registration etc., will all list this house as her place of residence. There are people who could truthfully sign a statutory declaration and state in any court that she has lived there for 6 years, including yourself. Therefore, even without a lease in place, she is considered a tenant under the Residential Tenancies Act.

    This gives her tenancy rights, even without a cent changing hands. So to evict her, youÔÇÖre going to have to give her a valid, written Termination Notice. AND if your uncle is going to put the property on the market for sale, he will also need to give her a valid, written notice in regards to that too.

    If she continues to be abusive, then your uncle may have an option to evict her sooner under the DV laws that were introduced a couple of years ago but they came is as I was leaving the industry and you would need to seek the correct advice around these laws elsewhere.

    Basically, you need to consult a solicitor that is across the RTA and other laws regarding property otherwise you could end up getting your uncle in a lot of trouble. Hope this helps.

    If sheÔÇÖs been there for 5 years plus AND is receiving a carers payment for your uncle, there is another layer of complexity to her tenants rights

    She will be considered a ÔÇ£protected personÔÇØ in terms of asset tests-meaning the house is *excluded* From the assets tests for entering aged care

    You need to apply to NCAT to have her tenancy terminated. Verbal agreements count as a lease in NSW.
    This will be the least messy way to get her out.
    IÔÇÖd also suggest your uncle getting a protection order against her. The police will be able to do much more once that order is in place.
